Resolution - 1982 - 2-82 - Establishing City Council Meetings - 01/26/1982 RESOLUTICN 2-82 A RESOLUTION RESCINDING RESOLUTICN 1-80 AND AroPTING A NEW RESOLUTICN ESTABLISHING RULES AND ORDER OF PIDCEDURE OOVERUNG CI'IY CDUNCIL MEETINGS OF THE EAGLE CI'IY CDUNCIL. BE IT RESOLVED BY THE MAYOR AND CDUNCIL OF '!HE CI'IY OF EAGLE, IDAHO THAT: Section 1. The rules of order of procedure herein oontained shall govern deliberations and neetings of the Council of Eagle, Idaho. Section 2. Regular neetings of the Council shall be held on the second and fourth Tuesday of every m::mth. Section 3. Special neetings nay be held at the call of the nayor by written notice to each ræmber of the council stating the object of the neeting as provided by Section 50-604, Idaho Code. One-half (1/2) plus one (1) of the rœnbers of the full oouncil shall have the p:JWer to call special neetings of the city council by serving written notice to all ræmbers of the council stating the object of the meeting as provided by Section 50-706, Idaho Code. The city clerk shall record the proceedings of all special neetings in the city council rreeting records. Section 4. All regular neetings shall convene pranptly at 7:30 P. M. at the Eagle City Hall. Section 5. A qoorum shall be a najority of the full council and questions before the council shall be decided by a najori ty of the ræmbers present unless otheIWise provided by law. Section 6. 'Ihe presiding officer of the council shall be the rrayor, or in his absence the president of the council. In the absence of both the nayor and president of the council, the clerk shall call the council to order and call the roll. If there is a qwrum present, the council shall elect, by najority vote, a chairman to act until the arrival of the nayor or president of the oouncil. The presiding officer shall preserve strict order and decorum at all regular and special neetings. Section 7. Before proceeding with the business of the council, the city clerk or deputy city clerk shall call the roll of the ræmbers and the naræs of tlDse present shall be entered in the minutes. Section 8 . The nayor shall have a vote at city council neetings only when the council is equally divided. The nayor shall have the power to veto or sign any Section 9. ordinance passed by the council. Approval of claims against city Adjoumœnt Section 11. No oouncil ræmber shall speak rrore than twice on the sane subject without pennission of the presiding officer. Any person who is not a rrernber of the council shall Section 12. be allowed to address the council only after obtaining pennission from the presiding officer. MJtions shall be in writing when required by the Section 13. presiding officer or any ræmber of the oouncil. All resolutions and ordinances shall be in writing. Section 14. MJtions to reconsider must be by a rœnber who voted with the najority, and at the saIœ or next regular neeting of the council. Section 15. Whenever it shall be required by one or rrore rrernbers, the "yeas" and "nays" shall be recorded; and any member nay call for a division of the qœstion. Section 16. All qœstions of order shall be decided by the presiding officer of the council with the right of appeal to the council by any rœrnber . Section 17. MJtions to lay any natter on the table shall be first in order; and on all questions, the last amendrœnt, the rrost distant day, and the largest sum shall be first put. Section 18. All meetings of the council shall be open to the public. Section 19. A rrotion for adjoumœnt shall always be in order. Section 20. The chairman of each respective corrmittee, or the council rœrnber acting in his place, shall sutmi t or rrake all re¡:orts to the council when so requested by the presiding officer or any rrernber of the council. Section 21. All ordinances, resolutions or pro¡:ositions submitted to the council which require the expenditure of rroney, shall lie over until the next regular neeting; provided that such ordinances, resolutions or pro¡:ositions nay be considered earlier by unanirrous consent of the members present; and provided further, that this rule shall not apply to current expenditures of, or contracts previously nade with, or regular salaries or wages of employees of the city. Section 22. The city clerk, city treasurer, attorney, building inspector, librarian and such other employees of the City of Eagle, shall, when requested, attend neetings of the council and shall remain in the council room for such length of tine as the council nay direct. Section 23. No ordinance or resolution of a permanent nature shall be adopted at the meeting at which it is introduced unless unanirrous consent of the rrembers present is obtained for the imœdiate consideration of such ordinance or resolution, such consent shall be by roll call and the vote thereon spread on the minutes. Section 24. The passage of all ordinances or resolutions shall be by roll call vote of the council with the yea or nay of each being recorded. Section 25. The rules contained in Poberts Rules of Order shall govern the council in all cases to which they are applicable, and in which they are not inconsistent with the by-laws, special rules of order of this oouncil, or the laws of the State of Idaho. Section 26. The cut off date for the agenda shall be Thursday noon preceeding the Tuesday council neeting. Anyone requesting an i tern to be placed on the agenda shall notify the office of the city clerk before that tine. Section 27. The rules of the council nay be altered, amended or ~rarily suspended by a unanirrous vote of the members present. Section 28. This resolution shall go into effect upon its passage.
