A RESOLUTION OF THE CITY OF EAGLE, IDAHO, AMENDING THE FEE SCHEDULE
FOR SOLID WASTE COLLECTION SERVICES, PURSUANT TO THE FRANCHISE
AGREEMENT FOR THE COLLECTION, HAULING AND DISPOSAL OF MUNICIPAL
SOLID WASTE COLLECTION AND DEMOLITION WASTE AS STATED IN SECTION 9
"RATE ADJUSTMENTS", SUBSECTION A "CPI-U ADJUSTMENT" AND SUBSECTION B
"DISPOSAL AND GOVERNMENTAL FEE COST ADJUSTMENTS" AND SUBSECTION C
"OPERATING COST ADJUSTMENTS" PROVIDING FOR EFFECTIVE DATE.
WHEREAS, Section 9 "Rate Adjustments", subsection A "CPI-U adjustment" of the
Exclusive Franchise Agreement for the Collection, Hauling and Disposal of municipal solid waste
and construction and demolition waste between the City of Eagle and Hardin Sanitation provides
for fee adjustments according to the prior rolling twelve-month period of the Consumer Price Index
("CPI-U"); and
WHEREAS the CPI-U prior rolling twelve-month period increase was 2.6% and
WHEREAS, Section 9 "Rate Adjustments", subsection C "Operating Cost Adjustments of
the Exclusion Franchise Agreement for the Collection, Hauling and Disposal of municipal solid
waste and construction and demolition waste between the City of Eagle and Hardin Sanitation
provides may also petition the City for additional rate and price adjustments at reasonable times
on the basis of material or unusual changes in its costs of operations not otherwise the basis of any
other rate adjustments herein; and
WHEREAS, overall operations costs for the previous 24 months has increased
approximately 12%, yet the Provider is requesting an increase of 1.4% to offset these costs. The
total requested increases is 4% excluding the pass through costs associated with recycling services.
WHEREAS, Section 9 "Rate Adjustments", subsection B "Disposal and Governmental Fee
Cost Adjustments" of the Exclusive Franchise Agreement for the Collection, Hauling and Disposal
of municipal solid waste and construction and demolition waste between the City of Eagle and
Hardin Sanitation provides that the hauler may request increases to pass through documented
increases in disposal fees; and
WHEREAS, Republic Services Recycling Center (formerly owned/operated by Western
Recycling) has provided notice that they will be increasing fees by 15% effective January 1, 2025
for material processing. This fee increase will only impact those services that include recycling
and;
WHEREAS, notice of the proposed increase in fees was published in The Idaho Statesman,
a newspaper of general circulation within the City on November 29, 2024 and December 6, 2024,
as required by law; and
WHEREAS, pursuant to a public hearing on the proposed increase of fees held on
December 10, 2024, as required by Idaho Code §63-1311A, the City Council of the City of Eagle
(the "Council") desires to adopt fees as set forth below.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF EAGLE, IDAHO:
Section 1: That the following increase in garbage collection service fees are hereby adopted:
See Exhibit A attached hereto and incorporated herein as if stated in full
Section 2: That this Resolution shall be in full force January 1, 2025.
ADOPTED by the Eagle City Council, Eagle Idaho.

RE: Request for Solid Waste Rate Adjustment from Hardin Sanitation
Dear Mayor Pike and City Council:
We would like to be placed on the City Council's agenda December 10th, to request a 4% price
increase for both Commercial and Residential service, effective January 1, 2025. The proposed
adjustment is based on both the Consumer Price Index-U for the State of Idaho and our increase in
year over year direct costs for operations. This adjustment equates to an added $.82/month for our
most frequently utilized service level. We are requesting the Solid Waste rates be adjusted per our
contract/franchise agreement (sec 9 A & B).
In addition to this request, we would also like to add an adjustment to the rate per Section 9 B that
covers "pass through for documented disposal increases". I have attached a letter from RSG that
shows a 15% increase for recycling disposal. Please note that only the rates that include recycling
are being adjusted for this increase.
Over the course of providing two (2) years of service to the citizens of the City of Eagle,
we have actively sought out new cost-effective ways to provide an elevated level of service to our
customers. We have invested over $950K in our operations over the last year to assure that level of
service to the City of Eagle. Hardin Sanitation and our employees are committed to "Doing Good in
our communities."

We at the Republic Services Recycling Center are continually striving to
improve our operations and deliver cost effective recycling services to our
customers. We remain committed to the environment, which is reflected in the
ongoing development of our state-of-the-art facility. Our operations exceed all
applicable and anticipated federal, state, and local regulations. In turn, we
provide customers with environmentally sound, reliable, climate -forward
recycling processing.
In addition to technological recycling facility improvements, we have experienced
operational cost increases this past year, including but not limited to parts, labor,
construction materials, petroleum products, insurance, and financial assurance.
After carefully reviewing our operations, it is necessary to increase current
processing rates by 15%, effective 1/1/2025.
