Resolution - 1988 - 10-88 - Canvas Of Special Election (Liquor) - 11/09/1988 RESOLUTION NO. 10-88 A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A SPECIAL ELECTION HELD ON NOVEMBER 8, 1988, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY THE QUESTION OF WHETHER THE SALE OF LIQUOR BY THE DRINK SHALL BE LICENSED AND PERMITTED IN THE CITY OF EAGLE, AND DIRECTING THE CITY CLERK TO CERTIFY THE RESULTS OF SAID SPECIAL ELECTION TO THE DIRECTOR OF THE DEPARTMENT OF LAW ENFORCEMENT OF THE STATE OF IDAHO WHEREAS, pursuant to a petition duly filed with the City Clerk in accordance with section 23-917, Idaho Code, and pursuant to Resolution No. 6-88, adopted on October 18, 1988, calling a special election for such purpose, a special election was duly held and conducted in the City of Eagle (the "City") on November 8, 1988, on the question of whether the sale of liquor by the drink shall be licensed and permitted in the City: and WHEREAS, the City Council now desires to canvass the votes and to declare the results of said election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EAGLE, IDAHO, as follows: section 1: The city Council has examined the returns of the special election held and conducted in the city on November 8, 1988, on the following proposition: SHALL THE SALE OF LIQUOR BY THE DRINK BE LICENSED AND PERMITTED WITHIN THE CITY OF EAGLE, IDAHO? The City Council hereby canvasses said returns and declares the results of said election as follows: Number of Votes in Favor Number of Votes Aqainst 402 245 section 2: The City Council hereby finds, determines, and declares that said proposition for the sale of liquor by the drink carried by the requisite majority of the qualified electors of the city voting at said election, that said election was in all respects held and conducted in compliance with the applicable law, and that the City Council is authorized to proceed with the authorization of the licensing and sale of liquor by the drink in the City in conformance with the laws of Idaho. No license shall be issued prior to adoption of an ordinance providing for the issuance of retail liquor licenses. Page 1 section 3: The City Clerk is hereby authorized and directed to cause the results of said special election to be certified to the Director of the Department of Law Enforcement of the state of Idaho. section 4: This Resolution shall take effect from and after its passage and approval.
