AN ORDINANCE ANNEXING CERTAIN REAL PROPERTY SITUATED IN THE
UNINCORPORATED AREA OF ADA COUNTY IDAHO, AND CONTIGUOUS To THE
CORPORATE LIMITS OF THE CITY OF EAGLE, To 'ffiE CITYOF EAGLE, IDAHO;
CHANGING 'THE ZONING CLASSIFICATION OF SAID REAL PROPERTY DESCRIBED
HERI-AN FROM RUT (RURAL -URBAN FRANSITION), MUD A (MIXED USE WITH A
DEVELOPMENT AGREEMENT), AND 'R-2-DA (RESIDENTIAL \vim A DEVELOPMENT'
A(REEMENT) TO MU-DA (MIXED USE WITH A DEVELOPMENT .AGREEMENT), 'R-2-
DA (RESIDENTIAL WITH A DEvnopmENT A(REEMENT), AND R-6-DA
(RESIDENTIAL WITH A DEVELOPMENT AGREEMENT, AND; AMENDING TEBH
zoNING MAP 0 TTIE CITY OF EAGLE TO REFLECT SAID CHANGE; DIRECTING
THAT COPIES OF THIS ORDINANCE BE FILED AS PR.OVIDED BY LAW; PROVIDING
A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating under
the laws of the State of Idaho and is authorized to annex to and incorporate within the boundaries
of the City contiguous real property in the manner provided by Section 50-222, Idaho Code; and
WHEREAS, TH Artie Wild, LLC, the owner of the real property situated in the unincorporated
area of Ada County and particularly described in Exhibit "A" and shown in Exhibit "B" of this
ordinance has requested, in writing, annexation of said real property to the City of Eagle; and
WHEREAS, the property described in Exhibit "A" is identified by the Ada County Assessor's
Office as tax parcel .numbers SO403223250 and SO40323000; and
WHEREAS, the properties included within Exhibits "C, E, and G" is identified by the Ada
County Assessor's Office as tax parcel numbers SO4)3223250, S0403234000, S04041'10110,
and SO404417250; and
WHEREAS, the owners of the real property situated within the City of Eagle and particularly
described in Exhibit "C" and shown in Exhibit "D" of this ordinance has requested, in writing, a
rezone from RUT and R-2-DA to MU-D.A; and
WHEREAS, the owners of the real property situated within the City of Eagle and particularly
described in Exhibit "E" and shown. in Exhibit "F" of this ordinance has requested, in writing, a
rezone from RUT and MU-DA to R-2-DA; and
WHEREAS, the owners of the real property situated within the City of Eagle and particularly
described in Exhibit "G" and shown in Exhibit "H" of this ordinance has requested, in writing, a
rezone from RUT and MU-DA to R-6-DA; and

WHEREAS, the Planning and Zoning Commission of the City, pursuant to public notice as
required by law, held a. public hearing on April 15, 2024, as required by Section 67-6525, .Idaho
Code, and made a recommendation to the Mayor and Council; and
WHEREAS, the Eagle City Council, pursuant to public notice as required by law, held a public
hearing on May 28, 2024, on the proposed annexation described in Exhibit "A" and zoning for
the real property described. in Exhibit "C", Exhibit "E", and Exhibit "G", as required by Section
67-6525, Idaho Code, made findings and determined that.the requested annexation should be
granted and that zoning classifications of l'.40-DA, R-24)A, and R-6-DA for the property
described in Exhibit "C", Exhibit "E", and Exhibit "G", respectfully is appropriate to meet the
requirements of Idaho Code, Eagle City Code and the Eagle Comprehensive Plan and should be
granted.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO, as follows:
Section I: The Eagle City Council hereby finds and declares that the real property particularly
described in Exhibit "A", attached hereto and incorporated herein by reference, is contiguous to
the City, that said property can be reasonably assumed to be used for the orderly development of
the City, and that the owner of said property has requested, in writing, annexation thereof to the
City.
Section 2: The real property, all situated in Ada County, Idaho, adjacent and contiguous to the
City, particularly described in Exhibit "A" and as generally shown on Exhibit "B", attached here
to, and included herein by reference, is hereby annexed to the incorporated territorial limits of
the City of E.,'agle, Idaho.
Section 3: The City Council hereby finds and determines that the real property particularly
described in Exhibit "C" and generally as shown on Exhibit "D", attached hereto and
incorporated by reference, is hereby removed from the RUT (Rural -Urban Transition) and R.-2-
DA (Residential with a development agreement) zoning classifications and is hereby included in
the MU-DA (Mixed Use with a development agreement) zoning classification all pursuant to the
Zoning Ordinance of the City of Eagle. The City Council further finds and determines that said
zone change is in accordance with the Eagle Comprehensive Plan and relevant City Codes and
that the Zoning Map of the City is hereby amended to include the real property described in
Exhibit "C" in the :MU-DA zoning district.
Section 4 The City Council hereby finds and determines that the real property particularly
described in Exhibit "E" and generally as shown on Exhibit "F", attached hereto and
incorporated by reference, is hereby removed from the IWT (Rural -Urban Transition) and MU-
DA Nixed Use with a development agreenient) zoning classifications and is hereby included in
the R-2-DA. (Residential with- a development agreement) zoning classification all pursuant to the
Zoning Ordinance of the City of Eagle. The City Council farther finds and determines that said
zone change is in accordance with the Eagle Comprehensive Plan and relevant City Codes and
that the Zoning Map of the City is hereby amended to include the real property described in
Exhibit "E" in the R-2-:DA zoning district.

Section 5: The City Council hereby finds and determines that the real property particularly
described in Exhibit "G" and generally as shown on Exhibit "H", attached hereto and
incorporated by reference, is hereby removed from the RUT (Rural -Urban Transition) and MU-
DA (Mixed Use with a development agreement) zoning classifications and is hereby included in
the R-6-DA (Residential with a development agreement — PUD) zoning classification all
pursuant to the Zoning Ordinance of the City of Eagle. The City Council further finds and
determines that said zone change is in accordance with the Eagle Comprehensive Plan and
relevant City Codes and that the Zoning Map of the City is hereby amended to include the real
property described in Exhibit "G" in the R-6-DA zoning district.
Section 6: From and after the effective date of this Ordinance, all property and persons within
the boundaries and territory described above shall be subject to all ordinances, resolutions, police
regulations, taxation, and other powers of the City of Eagle.
Section 7: The provisions of this ordinance are hereby declared to be severable and if any
provision of this act or the application of such provision to any person or circumstance is
declared invalid for any reason, such declaration shall not affect the validity of remaining
portions of this ordinance.
Section 8: The City Clerk is hereby directed to file, within ten (10) days of passage and
approval of this Ordinance, a certified copy of this Ordinance with the offices of the Auditor,
Treasurer, and Assessor of Ada County, Idaho, and with the Idaho State Tax commission, Boise,
Idaho, as required by Section 50-223, Idaho Code, and to comply with the provisions of Section
63-215, Idaho Code, with regard to the preparation and filing of a map and legal description of
the real property annexed by this Ordinance.
Section 9: This Ordinance shall take effect and be in force from and after its passage, approval,
and publication as required by law. In lieu of publication of the entire ordinance, a summary
thereof in compliance with Section 50-901A, Idaho Code, may be published.

ORDNANCE BE FILED AS PROVIDED BY LAW: PROVIDING A SEVERABILfTY Cl Ai ISF; AND PROVIDING AN EFFECTIVE DATE
WHEREAS. the City of Eagle, Idaho is a municipal corporation organized and operating under the laws of he Slate of Idaho and is authorized to annex to and incor-
porate within the binderies of he City contiguous real property in the manner provided by Section 50-222, Idaho Code; and
WHEREAS, Di Antic Wild LLC. the owner of the real property situated h the unincorporated area of Ada County and perticubry described in Exhibit "A" and shown
in Exhibit "B" of this ordinance has requested, in writing, annexation of said real properly t0 the City of Eagle; and
WHEREAS, the property described in Exhibit "A" is identified by the Ada County Assessor's Office as tax parcel numbers S0403223250 and SO403234000; and
WHEREAS, the properties included within Exhibits "C, E, and G" Is identified by the Ada County Assessors Office as tax parcel numbers S0403223250. SO403234000,
S0404110110, and SO404417250; and
WHEREAS, he owners of the real property situated within the CM of Eagle and perticulary described in Exhibit "C" and shown in Exhibit "D" of his ordinance has
requested, in wring, a rezone from RIJT and R-2-DA to MU-DA; and
WHEREAS, the owners of the real property situated within the City of Eagle and particularly described in Exhibit -E' and shown in Exhibit "F" of this ordinance has
requested, in witting, a rezone from RUT and MU-DA to R-2-D4; and
WHEREAS. he owners of the real propeM situated within the City of Eagle and particularly described in Exhibit "G" and shown in Exhibit -H" of this ordinance has
requested. In writing, a rezone from RUT and MU-DA to R-6-DA; and
WHEREAS. the Planning and Zoning Commission of the City, pursuant to public notice as required by law, held a public hearing on April 15, 2024. as required by
Section 67-6525, Idaho Code, and made a recommendation to the Mayor and Council: and
WHEREAS, the Eagle City Council, pursuant to public notice as required by law, held a public hearing on May 28, 2024, on the proposed annexation described in
Exhibit 'A' and zoning for the real property described in Exhibit'C". Exhibit 'E", and Exhibit "G", as required by Section 67-6525, Idaho Code. made findings and
determined Met the requested annexation should be granted and that zoning classifications of MU-DA, R-2-DA, and R-6-DA for he property described in Exhibit
"C", Exhibit "E", and Exhibit "G". reorvrttully is approtxlate to meet the requirements of kfaho Code, Eagle City Code and the Eagle Comprehensive Plan and should
be granted.
NOW, THEREFORE, BE R ORDAINED BY THE MAYOR AND COUNCIL OF THE CRY OF EAGLE, IDAHO, as folows:
Section 1: The Eagle City Council hereby finds and declares that the real properly particularly described in Exhibit "A", attached hereto and incorporated herein
by reference, is contiguous to the City, that said property can be reasonably assumed to be used for the orderly development of the City. an that the owner of said
property has requested. in wring, annexation hereof to the City.
Section 2: The real properly, all situated in Ada Couny, Iah0, adjacent and contiguous to the City, particularly described in Exhibit "A" and as genenaiy shown on
Exhibit "B", attached here to, and included herein by reference, is hereby annexed to the incorporated territorial limits 0f the City of Eagle, Idaho.
Section 3: The City Council hereby finds and determines that the real property particularly described in Exhibit "C" and generally as shown on Exhibit "D", attached
hereto and incorporated by reference, is hereby removed from the RIfr (Rural -Urban Transition) and R-2-DA (Residential with a development agreement) zoning
classifications and is hereby included in the MU-DA )Mixed Use with a development agreement) zoning classification all pursuant to the Zoning Ordinance of the City
of Eagle. The CM Council further finds and detemrnes that said zone change is in accordance with the Eagle Comprehensive Plan and relevant Ciy Codes and
that the Zoning Map of the City is hereby amended to include the real property described in Exhibit "C' in the MU-DA zoning district.
Section 4 The City Council hereby finds and determines that he real property particularly described in Exhibit "E" and generally as shown on Exhibit "F", attached
hereto and incorporated by reference, Is hereby removed Iron the RUT (Rural -Urban Transition) and MU-DA (Mixed Use with a development agreement) zoning
classifications and is hereby included in he R-2-0A (Residential with a development agreement) zoning classification all pursuant to the Zoning Ordinance of the
City of Eagle. The City Council further fins and determines that said zone change is in accordance with the Eagle Comprehensive Flan and relevant City Godes
and that the Zoning Map of the City is hereby amended to include the real property described in Exhibit "E" in the R-2-DA zoning district.
Section 5: The City Council hereby finds and determines that the real property particularly described in Exhibit "G" and generally as shown on Exhibit "H", attached
hereto and incorporated by reference. is hereby removed from the RUT (Rural -Urban Transition) and MU-DA (Mixed Use with a development agreement) zoning
classifications and is hereby included in he R-6-DA (Resloentlal with a development agreement - PIA) zoning classiticatbn all pursuant to the Zoning Ordinance of
the City of Eagle. The City Council further finds and determines that said zone change is in accordance with he Eagle Comprehensive Plan and relevant City Codes
and that he Zoning Map of the City is hereby amended to include the real property described in Exhibit -G" in he R-6-DA zoning district.
Section 6: From and after the effective date of this Ordinance, all progeny and persons within the boundaries and territory described above shall be subject to all
ordinances, resolutions, police regulations, taxation, and other powers of the CM of Eagle.
Section 7: The provisions of this ordinance are hereby declared to be severable and if any provision of this actor the application of such provision to any person
Or circumstance is declared invalid for any reason, such declaration shall not affect he validly of remaining portions of this ordinance.
Se,,tiux 8: The City Cleve Is hereby directed t0 file, within ten (10) days of passage and approval of this Ordinance, a certified copy Of this Ordinance with the
offices of the Auditor, Treasurer, and Assessor of Ada County, Idaho, and with the Idaho State Tax commission, Boise, Idaho, as required by Section 50-223, Idaho
Code, and to gimpy with the provisions of Section 63-215. Idaho Code, with regard lO the preparation and filing of a map and legal description of the real properly
annexed by this Ordnance.
Section 9: This Ordinance shall take effect and be in lice from and after its passage, approval, and publication as required by Yaw. In lieu of publication of the
entire ordinance. a Summary thereof in compliance with Section 50-901A, Idaho Code, may be published.
