Minutes - 2024 - Planning & Zoning Commission - 09/16/2024 - RegularPLANNING AND ZONING COMMISSION MEETING MINUTES The Planning and Zoning Commission met in regular session on September 16, 2024. 1. CALL TO ORDER: Chairman Wright calls the meeting to order at 6:01. 2. ROLL CALL: WRIGHT, GUERBER, MCCAULEY, SMITH Absent: MCLAUGHLIN. A quorum is present. 3. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. SMITH moves to approve the consent agenda as presented. Seconded by GUERBER. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: None. 5. PUBLIC HEARINGS: ALL PUBLIC HEARING ITEMS ARE CONSIDERED ACTION ITEMS: • Public Hearings are legally noticed hearings required by state law. The public may provide formal testimony regarding the application or issue before the City Council. This testimony will become part of the hearing record for that application or matter. • Public hearing testimony time limit: Individuals testifying are allotted three (3) minutes for non -repetitive testimony. • Disclosure of ex parte and/or conflict of interest. A. CUP-2024-04 — Conditional Use Permit for Personal Wireless Facility — Verizon Wireless: Verizon Wireless, represented by Sarah Miller with Lynx Consulting, is requesting conditional use permit approval for a personal wireless facility (height over 50-feet) to be attached to an existing building. The 3.85-acre site is located within the Eagle River development on the north side of East Eagle River Street and East Riverside Drive on Lot 20 and a portion of Lot 19, Block 3, Mixed Use Subdivision No. 5 at 230 East Riverside Drive. (HSD) Shelly Mathisen representing Verizon Wireless provides an overview of the application and responds to questions from the board. City Planner Hailey Durham provides an overview of the application and responds to questions from the Board. MCCAULEY motions to approve CUP-2024-04 — Conditional Use Permit for Personal Wireless Facility — Verizon Wireless, Seconded by GUERBER. ALL AYES... MOTION CARRIES. 6. NEW BUSINESS: None. 7. REPORTS: A. Commission Reports: Smith asks City Attorney Victor Villegas to clarify the responsibilities of the Commission regarding providing a response when giving public testimony, and to confirm that the Commissioners are not at liberty to comment on public testimony, rather their responsibility is to listen and not respond. City Attorney Victor Villegas states that the Commission's responsibility is to listen and judge and come to a decision based on the testimony heard. B. City Attorney Reports: None. C.
