Findings - DR - 2024 - DR-2024-53 - Eagle Island Marketplace - Two Building Wall Signs and Two Monument Sign Tenant Panels BEFORE THE EAGLE DESIGN REVIEW BOARD IN THE MATTER OF AN APPLICATION ) FOR A DESIGN REVIEW FOR TWO ) BUILDING WALL SIGNS AND TWO ) MONUMENT SIGN TENANT PANELS ) FOR FLOOR AND DECOR FOR FLOOR ) AND DECOR OUTLETS OF AMERICA INC) FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER DR-2024-53 The above-entitled design review application came before the Eagle Design Review Board for their action on October 24, 2024. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Floor and Decor Outlets of America, Inc., represented by Summer Zimmers, is requesting design review approval for two halo illuminated building wall signs and two monument sign tenant panels. The 5.38-acre site is located within Eagle Island Marketplace, 420-feet north of West Chinden Boulevard and 625-feet east of North Linder Road at 1300 West Chinden Boulevard. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on September 10,2024. C. HISTORY OF RELEVANT PREVIOUS ACTIONS: On February 24, 2009, the Eagle City Council approved a Comprehensive Plan Map and Text amendment and annexation (once contiguous) and a rezone with development agreement for Eagle Island Marketplace(CPA-05-08/A-03-08/RZ-08-08. On July 14,2009,the Eagle City Council approved the common area landscaping within Eagle Island Marketplace, including Fred Meyer and Eight Multi-tenant Retail/Restaurant buildings(DR-13-09). On July 14,2009,the Eagle City Council approved a design review sign application for the master sign plan for Eagle Island Marketplace(DR-14-09). On April 5,2012,the City approved a design review application to modify the master sign plan for Eagle Island Marketplace to increase the height and square footage of the two-multi-tenant monument signs along Chinden Boulevard to twenty five feet(25')in height and one hundred ninety seven(197) square feet of sign area(DR-14-09 MOD). On July 10,2012,the City approved a design review application for exterior building modification to the"L"shaped building within Eagle Island Marketplace(DR-13-09 MOD). On August 10, 2021, the Eagle City Council approved a design review application for three retail buildings within Eagle Island Marketplace(DR-13-09 MOD2). This application has expired. On November 16, 2021,the City approved a design review application to modify the single door to a sliding double door and add a canopy on the south building elevation of the Fred Meyer building (DR-13-09 MOD3). THE DESIGN REVIEW BOARD RECEIVED AND REVIEWED THE FOLLOWING STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT AND ADOPTS THE STAFF REPORT AS PART OF THE DESIGN REVIEW BOARD'S FINDINGS OF FACT: A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. MASTER SIGN PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: 2. Two 15-foot high multi-tenant monument signs are permitted on Linder Road. a. Tenant copy will be fabricated from 1/8"thick flat cutout aluminum and pegged off the face of the tenant panel'/4". 3. Two 25-foot high multi-tenant monument signs are permitted on Chinden Boulevard. a. Tenant copy will be fabricated from 1/8"thick flat cutout aluminum and pegged off the face of the tenant panel'/4". MISCELLANEOUS: LIGHTING - The following types of signage illumination will be allowed by the landlord per Eagle City. Open pan channel (exposed neon), reverse pan channel (neon or LED halo illuminated)or flood lighting (exact fixture to be approved by the landlord). Internal illumination and or backlit illumination is prohibited. LETTER AND LOGO RESTRICTIONS-Copy and or logos utilized shall be the tenant's choice and must be approved by the landlord. C. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Eagle City Code Section 8-2A-2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called"Eagle Architecture". • Eagle City Code Section 8-2A-6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. e. The size, location, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to ensure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties,neighborhoods,or streets. • Eagle City Code Section 8-2A-8(B): Definitions GRAND OPENING: The promotional activity used by a new business or enterprise or for a grand opening for a business or enterprise under new management, to inform the public of their location and contribution to the business community. "Grand opening" does not mean the annual or occasional promotion of services or retail sales by a business. ILLUMINATION, INTERNAL: Illumination of a sign from any light source that is concealed or contained within the sign and becomes visible in darkness through a translucent surface, except for illumination, punch through letter signs. This includes characters, letters, figures, designs or outline which is illuminated by gas filled luminous tubes, such as neon, argon or fluorescent. • Eagle City Code Section 8-2A-8(C)(9): Prohibited Signs: e. Wall signs that extend above the parapet wall. g. Off premises signs, except as otherwise stated within this article. h. Banner signs placed within landscaped areas, or otherwise placed on posts inserted into the ground, except for grand openings, community events, community yard sales and yard sales for nonprofit organizations. o. Polyurethane and polyvinyl chloride (PVC) style inflatable balloons and blimps, larger than twenty four inches (24") in diameter, except for grand openings and community events. • Eagle City Code Section 8-2A-8(C)(12): Permitted Temporary Signs: b. Said banner signs shall be securely attached to a fence, building, structure or similar permanent fixture and shall not be permitted to be displayed for more than thirty (30) consecutive calendar days with a minimum of thirty (30) consecutive days between placements. No banner sign shall be placed within a landscaped area,or otherwise be placed on posts inserted into the ground. The maximum size for any such banner sign shall be forty eight(48)square feet. g. Construction Signs: Shall be placed on the construction site only between the time that a development application has been filed with the city and final issuance of certificate of occupancy. Contractors' signs may include banks, realtors, subcontractors, etc., and shall not exceed sixteen (16) square feet, except that thirty two (32) square feet may be permitted along state highways, unless legally required by governmental contract to be larger,and eight feet(8')shall be the maximum height. i. Grand Opening Signs: All signs, except for prohibited signs as regulated in this article, are allowed for a grand opening for a new business or enterprise or for a grand opening for a business or enterprise under new management for a maximum period of sixty (60) calendar days. • Eagle City Code Section 8-2A-8(C)(13)Sign Illumination: e. Halo illumination is permitted. g. All types of internal illumination is prohibited, except for automated signs and drive- through/drive-up service menu board signs as regulated in this article. D. DISCUSSION: • The applicant is proposing to construct two building wall signs and two monument sign tenant panels. The building wall sign located on the west building elevation is proposed to be halo illuminated and internally illuminated. Pursuant to Eagle City Code Section 8-2A-8(C)(13), internal illumination is prohibited. The applicant should be required to provide a revised sign elevation (west) showing the "&" not internally illuminated. The revised sign elevation should be reviewed and approved by staff prior to the issuance of a sign permit. The sign elevation shows the sign to say "Customer Pick-Up" and to be halo illuminated. The description on the sign elevation references halo illuminated and internal illumination and additional letters. The revised sign elevation should be reviewed and approved by staff prior to the issuance of a sign permit. • The applicant is proposing two monument sign tenant panels on the monument signs located along North Linder Road and West Chinden Boulevard. Both sign elevations do not include dimensions for the tenant panels and the text dimensions do not comply with the master sign plan. Monument#1 I Replacement Faces Action: •Manufacture and install(2)new replacement faces. •Faces to be aluminum with 1/2"FCOs,painted white,mounted IV onto panel with stand offs. FLOOR (2)Digitally printed Low Tack coming soon vinyl to be applied to DECOR ,' Roar Decor faces. Dimensions&material to be verified prior to manufacturing. SIDE VIEW The master sign plan requires the text on the panel to be fabricated from 1/8" thick flat cutout aluminum and pegged off the tenant panel 3/4". The applicant should be required to provide revised monument sign tenant panel elevations including the dimension of the tenant panels, and text shown to be 1/8" thick flat cutout aluminum pegged off the panel 3/4". The revised sign elevation should be reviewed and approved by staff prior to the issuance of a sign permit. • The sign package submitted by the applicant includes temporary signage for coming soon signs, grand opening signs,construction fence banners, inflatables, and pennants.All temporary signage should comply with Eagle City Code. STAFF RECOMMENDATION PROVIDED WITHIN THE STAFF REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC MEETING OF THE BOARD: A. A meeting to consider the application was held before the Design Review Board on October 24,2024, at which time the Board made their decision. Page 6 of 8 K:\Planning Dept\Eagle Applications\Dr\2024\Floor and Decor Signage DR-2024-53\Floor and Decor Signage Findings DRdoc BOARD DELIBERATION: Upon completion of the applicant's and staffs presentations,the Board discussed during deliberation that: • The Board is in favor of the proposed signage with the red color of the sign to match the red of the Fred Meyer sign. • The Board is in favor of allowing the coming soon portion of the monument sign tenant panels, provided they are removed when the retail building opens. BOARD DECISION: The Board voted 6 to 0 (Lindgren absent) to recommend approval of DR-2024-53 for a design review application for two building wall signs and two monument sign tenant panels for Floor and Decor, with the following staff recommended site specific conditions of approval and standard conditions of approval with text shown with underline to be added by the Board and text shown with strikethrough to be deleted by the Board. SITE SPECIFIC CONDITIONS OF APPROVAL: 1. Provide a revised sign elevation (west) showing the "&"not internally illuminated. The revised sign elevation shall be reviewed and approved by staff prior to the issuance of a sign permit. 2. Provide a revised sign elevation (north building elevation) showing the description to match the sign elevation and not internally illuminated. The revised sign elevation shall be reviewed and approved by staff prior to the issuance of a sign permit. 3. Provide revised monument sign tenant panel elevations including the dimension of the tenant panels, and text shown to be 1/8" thick flat cutout aluminum pegged off the panel 3/4". The revised sign elevation shall be reviewed and approved by staff prior to the issuance of a sign permit. 4. All temporary signage shall comply with Eagle City Code. 5. A sign permit is required prior to the installation of any signs on this site. 6. Provide a copy of the electrical permit for the sign installation prior to issuance of a sign permit. 7. Upon completion of the building wall signs and monument sign tenant panels, the applicant shall be required to request a site inspection to be completed by the Planning and Zoning Department. Upon verification that the building wall signs and monument sign tenant panels have been completed in compliance with the approved plans,a certificate of completion will be issued. 8. The "coming soon" sign on the monument sign tenant panels shall be removed at the opening of the retail building. Once the"coming soon" sign is removed, no additional signage shall be placed on the monument sign tenant panel. 9. Provide revised sign elevations showing the red on the signage to be a darker shade of red to match the red on the Fred Meyer signage. The revised sign elevations shall be reviewed and approved by staff and two members of the Design Review Board prior to the issuance of a sign permit. NOTE: In the event a Standard Condition of Approval conflicts with a Site Specific Condition of Approval contained herein the Site Specific Condition of Approval shall control. STANDARD CONDITIONS OF APPROVAL: 1. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code(one year from approval date). The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the City Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and the City Council for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modify the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. CONCLUSIONS OF LAW: 1. The Board reviewed the particular facts and circumstances of this proposed design review application (DR-2024-53) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan. 2. The Board reviewed the particular facts and circumstances of the proposed design review in terms of Eagle City Code 8-2A-13(B)(2)(i), and has concluded: i. The building wall signage and monument sign tenant panels will be required to be harmonious with the architectural design of the building, and will not cover nor detract from desirable architectural features.
