WHEREAS, Chapter 10, Title 46, Idaho Code, authorizes each
county in the State of Idaho to maintain or participate in an
intergovernmental disaster agency which, except as otherwise
provided under this resolution, has jurisdiction over and serves
the entire county; and
WHEREAS, the last formal effort to address the scope, mission
and structure of this organization within Ada County, Idaho, is now
nearly fifteen years old and in need of revision: and

WHEREAS, the Federal Superfund Amendments and Reauthorization
Act(SARA), Title 111, also known as the Emergency Planning and
Community Right-to-Know Act of 1986, Section 301 requires the
establishment of a State Emergency Response Commission, Emergency
Planning District, and a Local Emergency Planning Committee; and
WHEREAS, Idaho Code Title 39, Chapter 71, and Idaho Emergency
Response Commission Resolution 91-1 designates Ada County as an
Emergency Planning District, and authorizes the formation of a
Local Emergency Planning Committee pursuant to the regulations of
SARA Title 111.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF EAGLE, IDAHO:
that the City of Eagle, in official session assembled this
date, does hereby re-establish an intergovernmental disaster
agency, known as the Ada City/County Emergency Management
hereinafter called ACCEM. ACCEM shall be directed by the Ada
City/County Emergency Management Executive Council, hereinafter
referred to as the Council. The Council shall set policy, employ
ACCEM staff as needed, establish direction for staff, adopt bylaws
and provide funding apportioned in a manner agreed to by the
Council. A disaster emergency within the City of Eagle, however,
may be declared only by the Mayor of the City of Eagle. Bylaws,
adopted by a two-thirds vote of Council members, shall establish
Council membership, organizational structure, and staff roles; and
BE IT FURTHER RESOLVED, that the mission of ACCEM shall, at
the discretion of the Council, be to coordinate, mitigate, prepare
for, respond to and recover from disasters and emergencies
resulting from any natural or technological causes. ACCEM shall
identify potential hazards affecting local governments and other
jurisdictions within Ada County; prepare, keep current and
distribute an intergovernmental emergency operations plan;
coordinate resources before, during and after an emergency;
coordinate emergency management among Ada County, its incorporated
cities and other affected jurisdictions specifically including
warning, communication, planning, training, public education and
exercising. In addition, ACCEM shall be responsible for providing
coordination and control of emergency operations as may be deemed
necessary by the executive Council from time to time; and
BE IT FURTHER RESOLVED, that ACCEM shall be headed by a
coordinator who shall prepare and administer a program of
activities that is endorsed the Council and shall provide support
to the Council during disaster emergency operation; and
BE IT FURTHER RESOLVED, that a Local Emergency Planning
Committee, hereinafter referred to as LEPC, shall be formed in
accordance with SARA, Title 111, Section 301. The LEPC's mission
shall be to support and implement SARA, Title 11 as well as to
advise the Council on matters related to emergency management; to
increase local awareness, education and preparedness of all natural
and technological hazards; and to provide a continuing forum
through which all levels of government, business and industry, an
the general public can address issues relating to emergency
management. The LEPC shall establish bylaws by which it shall
function and present them to the Council for adoption.
The foregoing resolution supersedes all previous resolutions
pertaining to civil defence/emergency management which conflict
with the language an intent of this resolution.
