A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, AUTHORIZING THE
EXECUTION OF A DRAINAGE AGREEMENT BETWEEN THE CITY OF EAGLE AND
KESTREL DEVELOPMENT, INC., AND AUTHORIZING THE MAYOR TO EXECUTE
SUCH AGREEMENT; AUTHORIZING THE MAYOR TO EXECUTE A SETTLEMENT AND
RELEASE ON BEHALF OF THE CITY UPON COMPLETION OF THE TERMS OF THE
DRAINAGE AGREEMENT; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Eagle, Ada County, Idaho (the "City"), is a municipal corporation
duly organized and operating under the laws of the State of Idaho; and
WHEREAS, the City desires to enter into a Drainage Agreement with Kestrel
Development, Inc., to set forth drainage compliance standards between the parties; and
WHEREAS, the City desires to approve a form of Settlement and Release to be executed
by the City upon completion of the terms of the Drainage Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
CITY OF EAGLE, Ada County, Idaho, as follows:

Section 1: The City Council, having reviewed the Drainage Agreement between the
City and Kestrel Development, Inc., attached hereto and incorporated herein by reference,
approves the execution of the Drainage Agreement, and hereby authorizes the Mayor to execute
such Drainage Agreement on behalf of the City.
Section 2: The City Council, having reviewed the form of Settlement and Release,
attached hereto and incorporated herein by reference, approves the Settlement and Release, and
hereby authorizes the Mayor to execute such Settlement and Release upon completion of the terms
of the Drainage Agreement referenced above.
Section 3:

This Resolution shall take effect and be in force from and after its passage
