A RESOLUTION EXPRESSING THE INTENT OF THE CITY OF EAGLE TO REMOVE
PROPERTY OWNED BY THE CITY OF BOISE CITY FROM THE EAGLE CITY LIMITS
AND THE EAGLE AREA OF CITY IMP ACT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Boise City owns property generally known as the West Boise
Wastewater Treatment Facility (WBWWTF); and
WHEREAS, a portion of the WBWWTF lies within the boundaries of the City of Eagle
as annexed pursuant to Eagle Ordinance No. 235; and
WHEREAS, a portion of the WBWWTF also lies within the Eagle Area of City Impact;
and
WHEREAS, the City of Boise City and the City of Eagle believe that the entire
WBWWTF should be located within the Boise City Area of City Impact; and
WHEREAS, the City of Boise City has expressed its intent to request deannexation of the
Boise City owned property from the Eagle City limits; and
WHEREAS, the City of Boise City has also expressed its intent to request Eagle City to
join Boise City in negotiating with Ada County for a modification of their respective Areas of
City Impact to allow the WBWWTF to be included in Boise City's Area of City Impact; and
WHEREAS, the City of Boise and City of Eagle are working with the Eagle Sewer
District to address sewage collection and treatment issues in the Eagle area; and
WHEREAS, the City of Boise is currently negotiating with BW Inc. for the exchange of
property located at or near the WBWWTF; and
WHEREAS, the successful conclusions of negotiations between the City of Boise and
BW Inc. may impact the properties which are to be deannexed from the Eagle City limits or
removed from the Eagle Area of City Impact.
NOW THEREFORE, BE IT RESOLVED BY THE MA YOR AND COUNCIL OF THE
CITY OF EAGLE, IDAHO:
Section 1. That the City of Eagle hereby expresses its intent to work with the City of
Boise City in removing Boise City owned property from the Eagle City limits.
Section 2. That the City of Eagle hereby expresses its intent to work with the City of
Boise City in removing Boise City owned property from the Eagle City Area of City Impact.
Section 3. That this Resolution shall be in full force and effect immediately upon its
adoption and approval.
