RESOLUTION No. 97-14
A RESOLUTION OF THE EAGLE CITY COUNCIL, EAGLE, ADA COUNTY,
IDAHO REPEALING ANY AND ALL EXISTING COMPREHENSIVE PLANS AND
LAND USE DESIGNATION MAPS, AND ADOPTING THE 1997 COMPREHENSIVE
PLAN AND LAND USE DESIGNATION MAP; AFFIRMING THAT PRESCRIBED
NOTICE AND HEARING REQUIREMENTS WERE MET IN ACCORDANCE WITH
TITLE 67, CHAPTER 65, IDAHO CODE; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, On April 18, 1978, the Eagle City Council passed Resolution #4-78
adopting the 1978 Comprehensive Plan: and '
WHEREAS, On May 26, 1981, the Eagle City Council passed Resolution #5-81
amending the 1978 Comprehensive Plan; and
WHEREAS, On May 24, 1983, the Eagle City Council passed Resolution #3-83
again amending the 1978 Comprehensive Plan; and
WHEREAS, On April 30, 1985, the Eagle City Council passed Resolution #2-85
adopting the 1985 Comprehensive Plan; and
WHEREAS, On August 12, 1986, the Eagle City Council passed Resolution #5-
86 amending the 1985 Comprehensive Plan; and
WHEREAS, On February 10, 1987, the Eagle City Council passed Resolution #1-
87 again amending the 1985 Comprehensive Plan; and
WHEREAS, On February 9, 1988, the Eagle City Council passed Resolution #2-
88 amending the 1987 Comprehensive Plan and adopting the 1988 Comprehensive Plan;
and
WHEREAS, On February 28, 1989, the Eagle City Council passed Resolution #1-
89 amending the 1988 Comprehensive Plan adopting the 1989 Comprehensive Plan; and
WHEREAS, On March 27, 1990, the Eagle City Council passed Resolution #2-90
amending the 1989 Comprehensive Plan adopting the 1990 Comprehensive Plan; and
WHEREAS, On May 11, 1993, the Eagle City Council passed Resolution # 4-93
repealing any and all previous Comprehensive Plans and Land Use Designation Maps and
adopting the 1993 Comprehensive Plan and Land Use Designation Map; and
WHEREAS, In 1995, the Eagle City Council amended the 1993 Comprehensive
Plan and adopted the current 1995 Comprehensive Plan; and
WHEREAS, Legal notice for the Planning and Zoning Commission to hold a

public hearing on June 16, 1997, was published in the West Ada Express on May 30,
1997, June 3, 1997, and June 6, 1997, and a public service announcement was sent to
radio and television stations and the Idaho Statesman; and
WHEREAS, The Planning and Zoning Commission held a public hearing on
June 16, 1997, to receive public testimony regarding setting the focus on generally what
issues were to be considered regarding upcoming City initiated Comprehensive Plan
amendments, annexation of land, zoning map amendments, and zoning district
amendments. The Commission set the focus at that time; and
WHEREAS, On July 9, 1997, ESP Printing Company mailed 5,831 fliers to a list
of all property owners, supplied by Ada Planning Association, and a list of all residents,
supplied by ESP Printing Company, within the City of Eagle, current Impact Area, and
Impact Area that was proposed by the Commission. The flier notified the public about
public workshops regarding the proposed amendments; and
WHEREAS, On July 10, 1997, the proposed Comprehensive Plan and Land Use
Designation Map were transmitted to other jurisdictions, agencies, and entities; and
WHEREAS, On July 16, 1997, July 19, 1997, July 23, 1997, and July 26, 1997,
four public workshops were held to gain public input on the proposed amendments to the
Comprehensive Plan and Land Use Designation Map; and
WHEREAS, Legal notice of the Planning and Zoning Commission hearing on the
amendments was published in the West Ada Express on July 15, 1997, July 18, 1997, and
July 22, 1997, and a public service announcement was sent to radio and television
stations and the Idaho Statesman; and
WHEREAS, The Planning and Zoning Commission held a public hearing on
August 4, 1997, and August 18, 1997, to receive public testimony at which time, on
August 18, 1997, the Commission passed a motion recommending approval of the
Comprehensive Plan and Land Use Designation Map amendments to the Council; and
WHEREAS, Legal notice of the City Council hearing was published in the West
Ada Express on September, 2 1997, September 5, 1997, and September 9, 1997, and a
public service announcement was sent to radio and television stations and the Idaho
Statesman; and
WHEREAS, The City Council held a public hearing on September 23, 1997, to
receive public testimony at which time the Council closed the public hearing.
WHEREAS, The City Council, on October 14, 1997, voted to approve the
Comprehensive Plan and Land Use Designation Map amendments; and

WHEREAS, The City Council hereby finds that the proposed amendments to the
1995 Comprehensive Plan complies with the provisions of Section 67-6508 of the Idaho
Code; and
WHEREAS, Section 67-6509(b) of the Idaho Code, provides that the City
Council may adopt, amend or repeal a Comprehensive Plan.
NOW THEREFORE, BE IT RESOLVED BY THE MA YOR AND COUNCIL OF THE
CITY OF EAGLE, IDAHO.
The Eagle City Council hereby amends the existing 1995 Eagle City
Comprehensive Plan, with the new Land Use Designation Map attached hereto as
considered, heard and adopted by the Council at its September 23, 1997, and October 14,
1997, meetings.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 14th day of October, 1997.
