Resolution - 2019 - 19-15 - Vacate All Or A Portion Of The Rear Public Utility, Irrigation, And Drainage Easements And The Side Lot To Common Areas On Blocks 2,3,4, And 5. - 03/26/2019ORIGINAL RESOLUTION No. 19-15 A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE ALL OR A PORTION OF THE REAR PUBLIC UTILITY, IRRIGATION, AND DRAINAGE EASEMENTS AND THE SIDE LOT LINE PUBLIC UTILITY, IRRIGATION, AND DRAINAGE EASEMENTS LOCATED ADJACENT TO COMMON AREAS ON BLOCKS 2, 3, 4, AND 5, WILLIAMSON RIVER RANCH SUBDIVISION NO. 1, AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The Land Group, Inc. represented by Tamara Thompson, requested a vacation to the final plat of Williamson River Ranch Subdivision No. 1 to remove a portion or all of the rear public utility, irrigation, and drainage easements and remove the side lot line public utility, irrigation, and drainage easements located adjacent to common areas on Blocks 2, 3, 4, and 5 (Williamson River Ranch Subdivision No. 1); and WHEREAS, On February 19, 2019, the Commission recommended approval of the vacation (VAC -01-19), to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on February 9, and February 16, 2019; and WHEREAS, On February 26, 2019, the City Council held a public hearing on the proposed vacation (VAC -01-19), and voted to approve the vacation; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates a portion or all of the rear public utility, irrigation, and drainage easements and vacate the side lot line public utility, irrigation, and drainage easements located adjacent to common areas on Blocks 2, 3, 4, and 5, as considered, heard and approved by the Council at its February 26, 2019, public hearing for application number VAC -01-19 and as shown on the attachments hereto (Exhibit A). This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, Idaho, this 26th day of March, 2019.
