A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, FINDING THAT
AN IMMINENT PERIL TO THE PUBLIC WELFARE EXISTS AND IMPLEMENTING
IMMEDIATELY A MORATORIUM ON ZONING, SUBDIVISION, DESIGN REVIEW,
SIGN AND BUILDING PERMITS WITHIN THE DESIGN REVIEW OVERLAY DISTRICT
WHEREAS, the City of Eagle (the "City") is currently
undertaking a comprehensive review of its design review ordinance¡
and
WHEREAS, the City
development plan¡ and
is
currently
preparing
a
downtown
WHEREAS, the design review ordinance amendments and downtown
development plan may significantly change the current plan for
development within the design review overlay district as set forth
in Title 8 of the Eagle City Code: and
WHEREAS, the City expects significant new development within
the design review overlay district in the very near future which
may be incompatible with the amended design review ordinance and
downtown development plan¡ and
WHEREAS, pursuant to Idaho Code Section 67-6523, the City may
adopt an emergency ordinance declaring a moratorium on certain
classes of permits for a period not to exceed one hundred and
twenty (120) days.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EAGLE, IDAHO, as follows:
Section 1: The City Council hereby finds that an imminent
peril to the public welfare exists caused by the current planned
amendment to the City's Design Review Ordinance, the ongoing
Downtown Development Plan and applications for development in the
downtown area which are expected to be filed with the City in the
near term and which may not be compatible with the future
development plan for that area.

Section 2: The City Council hereby declares a moratorium on
all zoning, subdivision design review, landscaping, sign and
building permits or applications for development within, or
proposed to be included within, the Design Review Overlay District
as set forth in Eagle City Code § 8-2A-3. This moratorium does not
apply to maintenance and repair of existing buildings.
Section 1: This moratorium terminates upon the adoption of
a new design review ordinance and downtown development plan or
September 4, 1996, whichever OCcurs first.
Section "l: This Resolution shall take effect immediately
upon its passage and approval.
