Resolution - 1994 - 03 - Promoting Compatability Between Zoning Districts Located In The City Of Eagle Impact Area And Locations In Ada County - 04/26/1994 RESOLUTION NO 3-94 A RESOLUTION OF THE CITY OF EAGLE PROMOTING COMPATIBILITY BETWEEN ZONING DISTRICTS LOCATED WITHIN THE CITY OF EAGLE IMPACT AREA AND LOCATIONS IN ADA COUNTY, OUTSIDE THE EAGLE IMPACT AREA WHEREAS, in order to identify lands lying in those unincorporated portions of Ada County which are agricultural lands and have some basic public services such as public street access and fire protection which are not suitable for urban development, and will allow limited residential development which maintains a rural environment, the following two options are for development are provided: 8-4B-2 PLANNED DEVELOPMENT - RESIDENTIAL (PDR) Subdivisions of land, which result in more than five (5) lots, where the minimum lot size is (10) acres, may be permitted in this Zone, only through the planned development (PD) procedure established in Chapter 9 of this Title. 8-4B-7 NONFARM DEVELOPMENT - RESIDENTIAL Within the RR Zone, nonfarm development which includes residential use, may be allowed at a gross density of one dwelling unit per five (5) acres, provided that the applicant complies with the provisions of this Section. Purpose: The purpose of this Section is to encourage the designation and maintenance of open space area, which enhances the rural environment, by authorizing the applicant to decrease building lot sizes in a limited portion of the development. The resulting increase in gross density is intended to serve as an incentive for creative site planning, the maintenance of rural character and the efficient use of rural land, in areas which have basic public services such as public street access and fire protection. 2. No lot within the proposed development shall be smaller than one acre. Findings: In order to approve a nonfarm development application, the Board and Commission must find that the application: 1. Is compatible with adjacent farm uses, and does not seriously interfere with farming practices on adjacent lands; 2. Utilized innovative site preserves a rural environment; planning which u_------ '------~----- 3. Does not unduly disrupt prime agricultural land; 4 . Does not cause environmental impacts; any serious detrimental 5. Does not require excessive expansion of public services; and 6. Protects all gravity flow irrigation systems. WHEREAS, the proposed development shall achieve a minimum open space ration of seventy five one-hundredths (.75) and the open space area shall meet the following requirements: WHEREAS, the Greenways linking residential areas with other open space areas, which may contain bicycle paths, footpaths, and bridle paths. WHEREAS, typically open space will be preserved by deed- restricted private ownership for a period of not less than fifteen (15) years. WHEREAS, the City of Eagle Comprehensive Plan (Plan) was approved by the Ada County Commissioners on January 11, 1993. The Plan's purpose is to: Protect property rights and enhance property values. Encourage urban and urban-type development... that is in harmony with the rural character of the area. Avoid undue concentration of population and overcrowding of land. Develop and enhance.. . pathways within the City of Eagle and its impact area. Under the Community Design portion of the plan it calls for the city "to establish and maintain a development pattern and design criteria in keeping with the rural transitional identity of Eagle. This includes growth within the Impact Area that discourages or precludes the establishment of other City centers." The plan also calls for: Buffer and transition zones conflicting types of land use. to be developed between Managing growth and channeling it into orderly community development. Promote compatibility between zoning districts. ------ NOW THEREFORE, BE IT RESOLVED THE CITY COUNCIL OF THE CITY OF EAGLE, IDAHO, THAT: Section 1: The City Council of Eagle requests that when development within the 'RR' Rural Residential Zone comes before the Ada County Planning and Zoning Commission or the Ada County Commissioners that the development be at a minimum of ten (10) acres rather than the option of one (1) acre lots in order to provide more compatibility and harmony between the 'RR' and 'RT' Rural Transition Zone in the Eagle Impact Area. Section 2: The Greenways or pathways through the development should also be included to allow access to public lands (BLM). DATED THIS c '?~ day of (~¿ , 1994.
