A RESOLUTION ADOPTING AN AMENDED PLAT OF LOTS 35 THROUGH 46, BLOCK
1, ISLAND WOODS SUBDIVISION NO.2 (RERECORDED IN ADA COUNTY
RECORDS AS RECORD OF SURVEY NO. 2959 AMENDED LOT LINE ADJUSTMENT
SURVEY OF LOTS 35 THROUGH 46, BLOCK 1, ISLAND WOODS SUBDIVISION NO.
2), AND LOTS 58 THROUGH 65, BLOCK 1, ISLAND WOODS SUBDIVISION NO.3
LOCATED IN A PORTION OF GOVERNMENT LOT 6, SECTION 16, T. 4 N., R. 1 E.,
B.M., CITY OF EAGLE, ADA COUNTY, IDAHO, IN ORDER TO ELIMINATE A
REMNANT OF LAND ABUTfING A SLOUGH AND AMENDING THE
CORRESPONDING ZONING BOUNDARY TO REFLECT THE REVISED SUBDIVISION
BOUNDARY.
WHEREAS, in accordance with the initial survey of Island Woods Subdivision No.2
and Island Woods Subdivision No.3, a strip of land presently owned by Hendershot
Construction, Incorporated was identified as lying between the rear lot lines of the referenced
lots and the slough; and
WHEREAS, this strip of land, varying from approximately 35 to 71 feet wide (to the
center of the slough) by 1,475 feet does not conform to city standards for lot requirements and
is therefore classified as an uneconomic remnant of land; and
WHEREAS, it is the desire of all parties participating in this amended plat to revise
and modify the former plats thereby causing the respective lot owners to own, control and
improve the strip of land up to the water's edge; and
WHEREAS, an amended plat provides present and future land owners with a specific,
identifiable record, in the form of a recorded plat, superior to that provided by a lot line
adjustment/record of survey; and
WHEREAS, by defining the rear lot pins as witness monuments on this amended plat,
the existing lots may be extended to the center of the slough thus eliminating said remnant by
adding these small increments to the existing lots; anOd
WHEREAS, no new lots are being created, and no "subdivision" as defined by the
Eagle City Code will occur; therefore, no public hearings are required; and
WHEREAS, it was the intent of prior zoning actions that the zoning boundary conform
to the boundary of the platted subdivisions;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Eagle, that the
Amended Plat of Lots 35 through 46, Block 1, Island Woods Subdivision No.2 (Rerecorded
in Ada County records as Record of Survey No. 2959, Amended Lot Line Adjustment Survey
of Lots 35 through 46, Block 1, Island Woods Subdivision No.2) and Lots 58 through 65,
Block 1, Island Woods Subdivision No.3, located in a portion of Government Lot 6, Section
16, T.4 N., R.l E., B.M., City of Eagle, Ada County, Idaho, is hereby adopted and accepted

for signature by the Mayor for the purposes of revising the boundary to eliminate the
described remnant of land by extending the respective lot lines to the center of the slough, and
BE IT FURTHER RESOLVED by the Council that by accepting this revision, the
zoning boundary for the referenced subdivision lots is hereby amended to reflect the revision
in the respective lot boundaries.
BE IT FURTHER RESOLVED that this Resolution shall be in full force and effect
immediately upon its adoption and approval.
