RESOLUTION NO. 98-3
A RESOLUTION OF THE CITY OF EAGLE, IDAHO, PROVIDING FOR PROCEDURES FOR
THE ISSUANCE OF TEMPORARY CERTIFICATES OF OCCUPANCY; PROVIDING FOR
FEES FOR TEMPORARY CERTIFICATES OF OCCUPANCY; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City of Eagle, Ada County, Idaho (the "City") desires to establish procedures
for the issuance of Temporary Certificates of Occupancy;
WHEREAS, the City desires to approve a fee schedule for Temporary Certificates of
Occupancy and sureties;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF EAGLE, IDAHO:
Section 1: That the following procedures shall be used for issuance of a Temporary
Certificate of Occupancy (TCO):

1.
Under no circumstances will a TCO be issued if safety related items are incomplete
(i.e., stairlbalcony guardrails, egress to the building, smoke detectors, fire-resistive
construction, exterior siding, etc.).
2.
All final inspections are to be performed and approved by the City Building Official.
An exception to this rule would be in association with shell permits where tenant
finishes will be handled under separate permits.
3.
The City Building Official or City Zoning Administrator may, in their discretion and
as may be defined by Eagle City Code, issue a TCO or allow an extension of time for
a TCO in instances such as the following:
a.
When required public improvements are incomplete if the agency having
jurisdiction approves the TCO in writing.
b.
When required landscaping is not completed.
4.
Surety, in the form of an irrevocable letter of credit, certificate of deposit, or cash, in
the amount of 150% of the cost of any incomplete improvements, shall be required.
The City Zoning Administrator shall review and approve improvement cost estimates
The City Zoning Administrator and City Clerk shall review sureties prior to issuance
of a TCO. Sureties shall be issued by a local bank (EaglelBoise area).
5.
If the work requiring surety has not been completed at the time of expiration of the
TCO or letter of credit, whichever occurs first, the City will proceed to cash said
letter of credit and have the improvements completed.
6.
No occupancy will be permitted if the TCO expires unless a permanent Certificate of
Occupancy is issued by the City.
Section 2: That the following fee schedule for Temporary Certificates of Occupancy and
Sureties is hereby approved:
a. Temporary Certificate of Occupancy . . . . . . . . . . . . . . . . . . . . . . . $ 50.00

Section 3: That this Resolution shall be in full force and effect immediately upon its adoption
and approval.
