RESOLUTION No. 98-2
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE ALL LANDSCAPE AND
PATHWAY EASEMENTS ALONG THE WEST AND NORTH BOUNDARIES, AND
ALONG THE PROPERTY LINES OF 11 INTERIOR LOTS, OF THE FINAL PLAT OF
SPYGLASS SUBDIVISION AS SHOWN ON THE ATTACHMENTS HERETO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Peter A. Wierenga requested a vacation to the final plat of Spyglass
Subdivision to allow the removal of the landscape and pathway easements along the west and
north boundaries of the subdivision and along the property lines of II interior lots; and
WHEREAS, The residential subdivision consists of 25 residential lots, and 2 common
lots; and
WHEREAS, The 33.74-acre site is located on the northwest corner of Locust Grove and
Chinden Boulevard; and
WHEREAS, On October 6, 1997, the Commission passed a motion recommending
approval of the vacation, with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in
the West Ada Express on September 26, 1997; and
WHEREAS, On October 14, 1997, the City Council held a public hearing on the
proposed vacation, and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MA YOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates all landscape and pathway easements along the
west and north boundaries, and along the property lines of II interior lots, of the final plat of
Spyglass Subdivision, as considered, heard and approved by the Council at its October 14, 1997,
public hearing and as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
