RESOLUTION No. 99-1
A RESOLUTION OF THE EAGLE CITY COUNCIL TO V ACA TE ALL EASEMENTS
ALONG THE COMMON LOT LINE BETWEEN LOT 43 AND 44, BLOCK 2, AND TO
ACCEPT THE GRANT OF PERMANENT EASEMENT FOR THE PURPOSE OF
LOCATING, ESTABLISHING, CONSTRUCTING, MAINTAINING, REPAIRING, AND
OPERATING A PEDESTRIAN ACCESS ACROSS THE WESTERN PORTION OF LOT 43,
BLOCK 2 OF THE FINAL PLAT OF EDGEWOOD ESTATES SUBDIVISION NO.3 AS
SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Country Haven LLC, represented by Larry Laraway, requested a vacation to
the final plat of Edgewood Estates No.3. The proposed vacation would allow the removal of all
easements along the common lot line between Lot 43 and 44, Block 2; and
WHEREAS, Country Haven LLC, represented by Larry Laraway, grants to the City of
Eagle a 10- foot wide permanent easement for pedestrian access along the western portion of Lot
43, Block 2 of Edgewood Estates Subdivision No.3 as shown on the attachments hereto; and
WHEREAS, The 4.8-acre residential subdivision consists of 16 lots and is located on the
east side of Edgewood Lane approximately 800- feet north of E. State Street; and
WHEREAS, On September 14, 1998, the Commission passed a motion recommending
approval of the vacation, with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in
the Valley News on September 30, 1998, and October 7, 1998; and
WHEREAS, On October 13, 1998, the City Council held a public hearing on the
proposed vacation, and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates all easements along the common lot line between
Lot 43 and 44, Block 2, and accepts the grant of easement for a 10-foot wide permanent
easement for pedestrian access along the western portion of Lot 43, Block 2 of the final plat of
Edgewood Estates Subdivision No.3 as shown on the attachments hereto, as considered, heard
and approved by the Council at its October 13, 1998, public hearing and as shown on the
attachments hereto.

This Resolution shall be in full force and effect immediately upon its adoption and
approval.

Declaration of a Drug-free Idaho

WHEREAS, Idaho is our home - the place where we live and work and raise our
families; and
WHEREAS, Idaho is not immune to the blight of drug abuse that afflicts our entire
nation, harming families, individuals, and businesses; and
WHEREAS, the Association ofIdaho Cities, representing the 201 cities in Idaho, has
launched a statewide campaign to end complacency, ignorance, and apathy about
the impacts of drug abuse; and
WHEREAS, We understand that winning the fight against drugs is only possible as each
. sector of our society steps up to do its part and for us, as adults, to be role models;
and
WHEREAS, We know that 70% of current drug users have jobs and that up to half of all
Worker's Compensation claims are related to substance abuse in the workforce.
NOW, We declare we will do everything in our power to make Idaho drug-free; and
We will ask businesses in our city to adopt a drug-free workplace policies and
will lead the way within our own city organization, supporting legislation to
provide incentives for businesses which adopt drug-free workplace policies; and
We support Enough Ís Enough '99: March for Idaho by organizing all sectors of
our community to be involved, providing follow-up, and seeking new
opportunities for drug-free activities in our community.
We affirm that the battle against substance abuse and addiction is about our children.
We must help them walk drug-free through a drug-filled world.
Adopted November 20, 1998 by delegates to the Cities Summit.
