A RESOLUTION OF THE EAGLE CITÝ COUNCIL TO VACATE THE DRAINAGE,
UTILITY, AND MAINTENANCE EASEMENTS ALONG THE COMMON LOT LINES
BETWEEN LOTS 17 & 18 AND LOTS 18 & 19, BLOCK 1 OF TRIPLE RIDGE ESTATES
SUBDIVISION, AND THE PRIVATE ROAD, DRAINAGE, IRRIGATION, AND UTILITY
EASEMENTS ALONG AND OVER THAT PORTION OF NORTH TRIPLE RIDGE LANE
WITHIN LOTS 17 & 18, BLOCK 1 OF TRIPLE RIDGE ESTATES SUBDIVISION AS
SHOWN ON EXHIBIT "A".

WHEREAS, u.S. Bank, represented by Briggs Engineering, Inc., requested a vacation to
the final plat of Triple Ridge Estates Subdivision. The proposed vacation would allow the
removal of the drainage, utility, and maintenance easements along the common lot lines between
Lots 17 & 18 and Lots 18 & 19, Block 1, and the private road, drainage, irrigation, and utility
easements along and over that portion of North Triple Ridge Lane within Lots 17 & 18, Block 1
as shown on Exhibit "A"; and
WHEREAS, The 122.69-acre residential subdivision consists of 24-10ts and is located on
the east side of North Triple Ridge Place approximately Y2-mile north of Floating Feather Road;
and
WHEREAS, On August 16,1999, the Commission passed a motion recommending
approval of the vacation, with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in
the Valley News on August 25, 1999, and September 1, 1999 and was mailed to surrounding
property owners on September 3, 1999; and
WHEREAS, On September 14, 1998, the City Council held a public hearing on the
proposed vacation, and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A ofthe Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates the drainage, utility, and maintenance easements
along the common lot lines between Lots 17 & 18 and Lots 18 & 19, Block 1, and the private
road, drainage, irrigation, and utility easements along and over that portion of North Triple Ridge
Lane within Lots 17 & 18, Block 1 as shown on Exhibit "A", as considered, heard and approved
by the Council at its September 14, 1999, public hearing and as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
