A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE UTILITY AND
DRAINAGE EASEMENTS ALONG THE COMMON LOT LINES BETWEEN LOTS 22 AND
21 AND LOTS 20 AND 21, BLOCK 1 OF STREAMSIDE SUBDIVISION AS SHOWN ON
THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Starwood of Eagle, represented by David Powell with Toothman-Orton
Engineering Company, requested a vacation to the final plat of Streamside Subdivision. The
proposed vacation would allow the removal of the utility and drainage easements along the
common lot lines between Lots 22 and 21 and Lots 20 and 21, Block 1; and
WHEREAS, On September 5,2000, the Commission passed a motion recommending
approval of the vacation, with conditions, to the Council; and
WHEREAS, Legal notice ofthe City Council hearing on the vacation was published in
the Idaho Statesman on September 11, 12, and 13, 2000; and
WHEREAS, On September 26, 2000, the City Council held a public hearing on the
proposed vacation, and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates the utility and drainage easements along the
common lot lines between Lots 22 and 21 and Lots 20 and 21, Block 1, of Streamside
Subdivision as shown on the attachments hereto, as considered, heard and approved by the
Council at its September 26, 2000, public hearing and as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
