A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE SOUTHERN 25-
FEET OF THE 60-FOOT WIDE ACCESS AND UTILITY EASEMENT ALONG THE NORTH
LOT LINE OF LOT 2, BLOCK 2 OF PERIWINKLE SUBDIVISION AS SHOWN ON THE
ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, David Southers, represented by Jack Coon, requested a vacation to the final
plat of periwinkle Subdivision, The proposed vacation would allow the removal of the southern
25-foot ofthe 60-foot wide access and utility easement along the north lot line of Lot 2, Block 2;
and
WHEREAS, On August 14, 2000, the Commission passed a motion recommending
approval of the vacation, with conditions, to the Council; and
WHEREAS, Legal notice ofthe City Council hearing on the vacation was published in
the Idaho Statesman on August 29,30 and 31,2000; and
WHEREAS, On September t2, 2000, the City Council held a public hearing au the
proposed vacation, and voted to approve Ihe vacation wilh conditions; and
WHEREAS, The City Council hereby fmds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - procednre", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates the southern 25-feet of the 60-foot wide access
and utility easemeat aloug the north lot line of Lot 2, BJock 2 of periwiokle Subdivisiou as
shown on the attachments hereto, as considered, heard and approved by the Council at its
September 12, 2000, public hearing and as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
