RESOLUTION No. 00-15
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE UTILITY,
DRAINAGE AND IRRIGATION EASEMENTS ALONG THE EAST SIDE LOT LINE OF
LOT 1, BLOCK 27 OF BANBURY MEADOWS SUBDIVISION NO.3 AS SHOWN ON THE
A TT ACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Banbury Meadows LLC, represented by Roy Johnson, requested a vacation
to the final plat of Banbury Meadows Subdivision No.3. The proposed vacation would allow
the removal of the utility, drainage and irrigation easements along the east side lot line of Lot 1,
Block 27; and
WHEREAS, On November 6, 2000, the Commission passed a motion recommending
approval of the vacation, with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in
the Idaho Statesman on November 11, 13, and 14,2000; and
WHEREAS, On November 28, 2000, the City Council held a public hearing on the
proposed vacation, and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates the utility, drainage and irrigation easements
along the east side lot line of Lot 1, Block 27 of Banbury Meadows Subdivision No.3 as shown
on the attachments hereto, as considered, heard and approved by the Council at its November 28,
2000, public hearing and as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
