RESOLUTION No. 00-12
A RESOLUTION OF THE EAGLE CITY COUNCIL TO V ACA TE A DRAINAGE
EASEMENT ALONG THE SOUTH AND WEST SIDE LOT LINES OF LOT 8, BLOCK 1 OF
BONITA HILLS SUBDIVISION AS SHOWN ON THE ATTACHMENTS HERETO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Richard and Mary Jean Sims, represented by Scott Johnson with Glenn
Johnson Homes, requested a vacation to the final plat of Bonita Hills Subdivision. The proposed
vacation would allow the removal of the drainage easements along the south and west side lot
lines of Lot 8, Block 1; and
WHEREAS, On August 14,2000, the Commission passed a motion recommending
approval of the vacation, with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in
the Idaho Statesman on August 29, 30 and 31, 2000; and
WHEREAS, On September 12, 2000, the City Council held a public hearing on the
proposed vacation, and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates the drainage easements along the south and west
side lot lines of Lot 8, Block 1 of Bonita Hills Subdivision as shown on the attachments hereto,
as considered, heard and approved by the Council at its September 12,2000, public hearing and
as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
