RESOLUTION NO. 00-08
A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, APPROVING AND
AUTHORIZING THE EXECUTION OF AGREEMENT FOR THE CONVEYANCE OF REAL
PROPERTY WITH EDGE INVESTMENTS INe. AND ADDENDUM TO AGREEMENT
WITH DRAINAGE DISTRICT NO.2; AUTHORIZING THE MAYOR TO SIGN; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle City Council is authorized and empowered to enter into
contracts to acquire and convey real property pursuant to Idaho Code § 50-301 and 50-1401, et
seQ., and;
WHEREAS, the Mayor and City Council of the City of Eagle desire to acquire real
property adjacent to Drain No. 15 and maintain same for the benefit of the citizens of Eagle.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF EAGLE, Ada County, Idaho, as follows:
Section 1: That the City of Eagle hereby agrees to enter into the Agreement for the
Conveyance of Real Property with Edge Investments, Inc., a copy of which is attached as Exhibit
A incorporated by reference herein;
Section 2: That the City of Eagle hereby agrees to enter into the Addendum
Agreement with Drainage District No.2, a copy of which is attached as Exhibit B and
incorporated by reference herein.
Section 3: That the City of Eagle, a political subdivision of the State of Idaho, as
agreed to by the City Council, enters into and authorizes the Mayor to sign Exhibit A and Exhibit
B at such time set for closing by the signatories to said agreements, or as otherwise required by
the terms of said agreements.
Section 4:
That this Resolution shall be effective as of the date of its adoption.
