A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, APPROVING
AND AUTHORIZING THE EXECUTION OF A LETTER AGREEMENT FOR THE
SECOND EXTENSION OF CLOSING DATE OF EXCHANGE AGREEMENT AND JOINT
CLOSING INSTRUCTIONS: EAGLE RIVER, LLC AND THE CITY OF EAGLE; AND
AUTHORIZING THE MA YOR TO SIGN THE LETTER AGREEMENT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle City Council is authorized and empowered to enter into
contracts to acquire and convey real property pursuant to Idaho Code § 50-301 and 50-1401, et
seq.
WHEREAS, the Mayor and City Council of the City of Eagle entered into an Exchange
Agreement and Joint Closing Instructions with Eagle River, LLC, dated effective July 1, 1998,
and extended to October 1, 1998 by letter agreement dated August 26, 1998.
WHEREAS, the Eagle City Council desires to complete the property exchange and
desires to extend the closing date to no later than February 23, 2000.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF EAGLE, Ada County, Idaho, as follows:
Section 1: That the City of Eagle hereby agrees to enter into the letter agreement
entitled Second Extension of Closing Date of Exchange Agreement and Closing Instructions:
Eagle River, LLC and City of Eagle, Idaho, attached hereto and incorporated by reference
herein as Exhibit" A" .
Section 2: That the City of Eagle, a political subdivision of the State of Idaho, as
agreed to by the City Council, enters into and authorizes the Mayor to sign Exhibit" A" .
Section 3:
That this Resolution shall be effective as of the date of its adoption.
