RESOLUTION NO. 00-03
A RESOLUTION AUTHORIZING A LIMITED CONFLICT OF INTEREST WAIVER, AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Eagle, Ada County, Idaho, ("Eagle") is a municipal corporation duly
formed pursuant to the laws of the State of Idaho; and
WHEREAS, Aries Development LLc., P.O,Box 6887, Boise, ID 83707, ("Developer") is a
limited liability corporation acting as owner to oversee and direct the development of Brookwood
Subdivision located in the City of Eagle, Idaho; and
WHEREAS, Developer is required to construct a 250 gallon-per-minute well, a well house and
appurtenances to provide potable water for domestic use as a condition of their subdivision approval; and
WHEREAS, Eagle wishes to participate in the upgrade of the well from a proposed production
quantity of250 gpm to 1,000 gpm to better provide peak-demand supply to their City drinking water
system; and
WHEREAS, both Eagle and Developer wish to employ the same qualified professional engineer
to protect their mutual interests,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EAGLE, ADA
COUNTY, IDAHO as follows:
Section 1.: The City of Eagle elects to waive the conflict of interest for the City Engineer,
Holladay Engineering Co" in order to allow the City Engineer to enter into a contract with Developer to
provide for the design of the well and appurtenances thereto. This waiver extends only to design and
construction of the well and well house appurtenances including incumbent permitting and agency
coordination and does not allow participation by the City Engineer on behalf of Developer in any other
engineering issues associated with approval of the subdivision.
Section 2.: This Resolution shall take effect upon its passage and approval.
