A RESOLUTION OF THE EAGLE CITY COUNCIL TO V ACA TE THE BUILDING
ENVELOPE ON LOT 4, BLOCK 1, OF ESCONDIDA SUBDIVISION AS SHOWN ON THE
A TT ACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE,
WHEREAS, Boise River Builders, represented by Dave McKinnon with Pinnacle Engineers,
requested a vacation to the final plat of Escondida Subdivision. The proposed vacation would
allow the removal of the building envelope on Lot 4, Block 1; and
WHEREAS, On July 28,2003, the Commission passed a motion recommending approval
of the vacation, with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in
the Valley Times on August 5 and 12,2003; and
WHEREAS, On August 26, 2003, the City Council held a public hearing on the proposed
vacation, and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates the building envelope on Lot 4, Block 1, of
Escondida Subdivision as shown on the attachments hereto, as considered, heard and approved
by the Council at its August 26, 2003, public hearing and as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
