RESOLUTION NO. 02-12
A RESOLUTION OF THE CITY OF EAGLE, IDAHO ESTABLISHING A
MUNICIPAL PARK RESERVATION POLICY, REQUIRING AN APPLICATION,
MAINTAINING A RESERVATION LIST, ESTABLISHING PARK HOURS,
RESER V ATION TIME BLOCKS, AND PARK RESERVATION FEES SCHEDULE
FOR SPECIFIC PARKS, ADDITIONAL FEES, RESERVATIONS OF "FOR PROFIT"
ACTIVITIES NOT ALLOWED, WAIVER OF FEE REQUEST, RESERVATION
REQUIRED, ALCOHOLIC BEVERAGES WITHIN MUNICIPAL PARK SYSTEM;
AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, it is the desire of the Eagle City Council to establish a municipal
park reservation policy; and
WHEREAS, it is in the best interest of the City of Eagle to establish reasonable
procedures and fees for the reservation of municipal park facilities in the City of Eagle to
preserve the peace and tranquility of the parks, prevent overcrowding of the facilities, to
provide funds for the maintenance of parks, and to recoup a portion of the costs that the
City incurs as a result of processing the applications for reservations; and
WHEREAS, the fees set forth herein are reasonable and reflect, as closely as
reasonably possible, some of the costs of the City to process the various reservations and
a portion of the park maintenance costs.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COUNCIL OF EAGLE, IDAHO THAT THE FEES AND POLICIES SET FORTH
BELOW ARE HEREBY ADOPTED:
Section 1 APPLICATION REQUIRED:
A. Persons, associations, corporations, and other entities, desiring to use the
Eagle Municipal park picnic shelters or playing fields shall file an application
and submit the appropriate fees for the day and time desired. If the requested
time and location are available a record of the reservation shall be kept at
Eagle City Hall.
Section 2 RESERVATION LIST:
A. A list of reservations for each picnic shelter will be maintained at that
particular shelter to inform the public who has reserved the picnic shelter and
the time, or times, for which the shelter has been reserved; if the reservations
have been removed from the picnic shelter, the list maintained at Eagle City
Hall shall still be controlling.

Section 3 PARK HOURS:
A. Municipal parks shall be open from 1 hour before sunrise to one hour after
sunset, with the following exceptions:
1.) The tennis courts at Friendship Park shall be open for use until 12:00 p.m.
2.) The Eagle City Councilor a designated staff member may allow events to
continue past the dusk deadline. Requests must be made in writing and
submitted to the City Clerk for review and action. The City Clerk shall
respond within 5 working days as to whether the activity shall be
permitted or not. The applicant will be notified in writing of the action.
Section 4 RESERVATION TIME BLOCKS
A. Reservation fees are applicable towards a minimum 2 hour time block and
a maximum 4 hour time block.

Section 6 ADDITIONAL FEES:
A. Amusement equipment and large canopies $10.00 per time block, per item.
B. Clean up or repair fees will be charged if shelter or playing field is not left
clean. Actual costs will be billed to reservation holder.
Section 7 RESERVATIONS OF "FOR PROFIT" ACTIVITIES NOT ALLOWED.
A. No "for profit" activities will be granted a reservation.
B. The provisions of this Section shall not apply to:
1. Fundraising sales and events hosted by local service clubs or groups such
as Elks, Kiwanis, Lions, Boy or Girl Scouts;
2. Any organization exempt from taxation as provided by 26 USC 501 and
meeting all the requirements for the exemptions provided by 26 USC 503.
Section 8: WAIVER OF FEES REQUEST:
A. Local service clubs, groups, or any organization exempt from taxation as
provided by 26 USC 501 and meeting all requirements for the exemptions
provided by 26 USC 503 may submit a written request to the City Clerk
asking that the reservations fees be waived. The Clerk shall respond within
five (5) working days.
Section 9 RESERVATION REQUIRED; REMOVAL FROM SHELTER:
A. If person(s) refuse to vacate a shelter at time for which another party has
reserved, they (the person(s) who have not reserved the shelter) shall be
removed by either City employees or law enforcement officials, and may be
cited for disorderly conduct.
Section 10 ALCOHOLIC BEVERAGES WITHIN MUNICIPAL PARK SYSTEM.
A. Within the City park system, it shall be unlawful to possess or consume any
alcoholic beverage upon any street, parking lot or restroom. Per Eagle City

B. Permits: Per Eagle City Code:3-2D-4:
Within the City park system permits shall be required for the possession of
more than seven and one-half (7 Ih) gallons of alcoholic beverages.
Possession or consumption of alcohol shall be allowed at the City Council's
discretion in any of the prohibited areas listed in Section 6A, upon obtaining a
permit. Applications may be obtained at Eagle City Hall.
After its passage and approval this resolution shall be in full force and effective as of
October 1,2002.

encouraged at the public hearing. WRITTEN COMMENTS must be submitted no less than five (5) working
days prior to the day on which the public hearing is scheduled. Qualified individuals who need accessible
communication aids and services or other accommodations to participate in programs and activities are invited
to make your needs and preferences know to the 504/ADA Coordinator (Eagle City Clerk). Please give us at
least three to five days advanced notice so we can adequately meet your needs.
