RESOLUTION No, 02-02
A RESOLUTION OF THE EAGLE CITY COUNCIL TO ACCEPT A 5-FOOT WIDE
PERMANENT PUBLIC EASEMENT FOR PEDESTRIAN ACCESS LYING IN A PORTION
OF LOT 5 OF SCHMELZER ADDITION SHOWN ON THE ATTACHMENTS HERETO;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, The City of Eagle obtained a permanent public easement for pedestrian
access lying in a portion of Lot 5 of Schmelzer Addition. The public access easement will
provide for pedestrian access to the planned pedestrian bridge over the Eagle Drain; and
WHEREAS, The City Council hereby finds that the proposed permanent public easement
for pedestrian access complies with the provisions of Section 55-2102 Idaho Code, and the Eagle
Comprehensive Plan TransportationlPathway Network Map #2.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby accepts the 5-foot wide permanent public easement for
pedestrian access lying in a portion of Lot 5 of Schmelzer Addition as generally shown on
Exhibit A and as specifically described on Exhibit B, attached hereto and incorporated herein by
reference.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
