A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE A ~ STREET SECTION
OF RIGHT -OF- WAY TOGETHER WITH ALL UTILITY EASEMENTS WITHIN THE
RIGHT-OF-WAY AND THE ADJOINING lO-FOOT WIDE UTILITY EASEMENT
ABUTTING SAID RIGHT-OF-WAY FROM THE FINAL PLAT OF CREIGHTON HEIGHTS
SUBDIVISION. THE 30-FOOT WIDE BY 600-FOOT LONG (APPROXIMATE) RIGHT-OF-
WAY IS LOCATED ON THE WESTERN BOUNDARY LINE OF LOT 1, BLOCK 1 OF
CREIGHTON HEIGHTS SUBDIVISION, AS SHOWN ON THE ATTACHMENTS HERETO;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, ALSAM Trust, represented by Givens Pursley LLC, requested a vacation to
the final plat of Creighton Heights Subdivision. The proposed vacation would allow the removal
of a ~ street section of right-of-way together with all utility easements within the right-of-way
and the adjoining lO-foot wide utility easement abutting said right-of-way. The 30-foot wide by
600-foot long (approximate) right-of-way is located on the western boundary line of Lot 1, Block
1 of Creighton Heights Subdivision; and
WHEREAS, On February 5, 2001, the Commission passed a motion recommending
approval of the vacation, with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in
the Idaho Statesman on February 24 and 26,2001; and
WHEREAS, On March 13,2001, the City Council held a public hearing on the proposed
vacation, and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates the ~ street section of right-of-way together with
all utility easement within the right-of-way and the adjoining 10-foot wide utility easement
abutting said right-of-way from the final plat of Creighton Heights Subdivision. The 30-foot
wide by 600-foot long (approximate) right-of-way is located on the western boundary line of Lot

1, Block 1 of Creighton Heights Subdivision as shown on the attachments hereto, as considered,
heard and approved by the Council at its March 13, 2001, public hearing and as shown on the
attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 26th day of February, 2002.
