Resolution - 2001 - 09 - Vacate The Utility Drainage And Irrigation Easements Along The Side Lot Lines Of Lots 56-59, 63-66 & 75-78, Blk 7 Of Lexingoton Hills Subd No. 9 - 08/28/2001 ~~~ J. ~'J,ig.~~X~~ 0 ~~ ZÐOI SP -6 PH 3: 33 RECORDEO-R~Q~~.Gf. \ FEE~E~ IWt IOIQ.92181¡ RESOLUTION No, 01-09 A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE UTILITY, DRAINAGE AND IRRIGATION EASEMENTS ALONG THE SIDE LOT LINES OF LOTS 56 - 59, 63 - 66, AND 75 - 78, BLOCK 7 OF LEXINGTON HILLS SUBDIVISION NO.9 AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Crocker Building Company, represented by Scott Field with Roylance and Associates, requested a vacation to the final plat of Lexington Hills Subdivision No.9. The proposed vacation would allow the removal of the utility, drainage and irrigation easements along the side lot lines of Lots 56 - 59,63 - 66, and 75 - 78, Block 7; and WHEREAS, On April 2, 2001, the Commission passed a motion recommending approval of the vacation, with conditions, to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on April 7 and 9, 2001; and WHEREAS, On April 24, 2001, the City Council held a public hearing on the proposed vacation, and voted to approve the vacation with conditions; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A ofthe Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates the utility, drainage and irrigation easements along the side lot lines of Lots 56 - 59, 63 - 66, and 75 - 78, Block 7 of Lexington Hills Subdivision No.9 as shown on the attachments hereto, as considered, heard and approved by the Council at its April 24, 2001, public hearing and as shown on the attachments hereto.
