RESOLUTION NO. 01-06

A RESOLUTION AUTHORIZING A LIMITED CONFLICT OF INTEREST WAIVER,
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle, Ada County, Idaho, ("Eagle") is a municipal corporation
duly formed pursuant to the laws of the State of Idaho;
WHEREAS, the City of Star, Ada County, Idaho, ("Star") is a municipal corporation
duly formed pursuant to the laws of the State of Idaho;
WHEREAS, both Eagle and Star have appointed the law firm of Moore Smith Buxton
& Turcke, Chartered ("City Attorney") formerly known as Moore & McFadden,
Chartered, as their respective City Attorney pursuant to Idaho Code Sections 50-204 &-
208A;
WHEREAS, Eagle wishes to gift to and Star wishes to receive the personal property
described in Exhibit 1, attached hereto and incorporated by reference herein.
WHEREAS, the City Attorney for both and Eagle and Star have declared a conflict of
interest exists pursuant to the Idaho Rules of Professional Conduct Rule 1.7 regarding the
overlapping proposed areas of city impact; and,
WHEREAS, Eagle and Star wish to waive the City Attorney's conflict of interest as
specified herein;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EAGLE, ADA COUNTY, IDAHO as follows:
Section 1: The City of Eagle hereby waives the conflict of interest for the City
Attorney, Moore Smith Buxton & Turcke, Chartered, in order for the City Attorney to
draft documents necessary for the gifting the personal property described in Exhibit 1.
Section 2:
This Resolution shall take effect upon its passage and approval.
