RESOLUTION NO. 01-05
A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, ENACTING
THE INITIAL BYLAWS OF THE EAGLE ARTS COMMISSION; PROVIDING FOR
ORGANIZATION, ELECTION, TERMS, FILLING OF VACANCIES, MEETINGS,
AND DUTIES OF THE COMMISSION, PROVIDING FOR AMENDMENT TO THE
BYLAWS; PROVIDING FOR OTHER MATTERS; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, by Ordinance No. 380 the City Council

Commission ("the Commission") and the duties thereof; and

WHEREAS, the Mayor and Council desire to establish the
initial bylaws for the Commission, after which amendments are to
be made by two-thirds vote of the Commission and approved of the
Council;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF EAGLE, Ada County, Idaho, as follows:
Section 1: That the initial bylaws of the Eagle Arts
Commission, attached hereto as Exhibit "A" and incorporated
herein by reference, be and hereby are enacted by the Mayor and
Council of the City of Eagle.
Section 4: That this Resolution shall be effective as of
the date of its adoption.

A
Bylaws of Eagle Arts Commission
ARTICLE I
ORGANIZA TION
Section 1. Name: The name of the Commission shall be the "Eagle Arts Commission"
Section 2. Statement of Purpose: The purpose of this Commission is to assist the City Council
as the official municipal advisory body on the arts. This Commission will promote, coordinate
and strengthen public programs to further the artistic and cultural development of the City.
ARTICLE II
COMMISSION
Section 1. The Commission. The Commission shall consist of five (5) members to be appointed
by the Mayor and confirmed by the City Council. Members shall reside in the City of Eagle. No
organization, which is a potential recipient of City arts funding shall have on the Commission
more than one person who serves on its board or staff.
Section 2. Term of Office. The term of office for each member will be three (3) years-:-,
provided, however, no member shall serve more than two (2) consecutive terms.
Section 3. Vacancies. The Mayor and City Council shall fill a vacancy on the Commission from
a list of candidates to be submitted by the remaining members of the Commission. The
Commission shall make public announcements of any vacancy and shall solicit nominations
from citizens before submitting a list of candidates to the Mayor and City Council.
Appointments that replace a vacancy of an incomplete term will serve the remainder of the three
(3) years.
Section 4. Conflict of Interest. No Eagle Arts Commission member may vote on an issue that
financially benefits such member, the member's immediate family or the member's business and
corporate affiliates.
ARTICLE III
OFFICERS
The Commission shall elect a Chairman, a Vice Chairman and a clerk for one-year terms. Other
officers may be appointed at the discretion of the Commission. Officers will be elected at the
first regular meeting after the annual appointment of Commissioners by the Mayor and City
Council.

ARTICLE IV
MEETINGS
Section 1. Regular Meetings. Regular meetings of the Commission will be held without notice
on the third Saturday of each month (unless otherwise notified). Special meetings will be called
as needed.
Section 2. Quorum. A quorum will be three (3) Commission members for the transaction of
business.
ARTICLE V
ADVISORY COMMITTEES
The responsibilities shall include the following:
A. To advise the City Council on ways in which City Government might best serve the
public with regard to matters involving the arts.
B. To encourage and aid the appreciation and awareness of, participation in, and
preservation of the arts among all citizens of Eagle.
C. To encourage cooperation and coordination among individuals, organizations and
institutions concerned with the arts in Eagle.
D. To promote and expand the cultural resources of Eagle, thereby facilitating
employment for artists and the development of self-sustaining arts programs.
E. To formulate in cooperation with other City agencies a long-range plan for the
development of a thri ving cultural climate in Eagle.
ARTICLE VII
DUTIES
The duties shall include the following:
A. To initiate, sponsor, conduct or support, alone or in cooperation with other public or
private agencies, public programs in the arts.
B. To advise the City as to the availability and adequacy of facilities and space for the
presentation of cultural activities.
C. To review and advise on the aesthetic aspects of all works of art or designs or public
monuments under consideration to be accepted or commissioned by the City.

D. To prepare and submit budgetary recommendations to the City Council for annual
expenditures necessary to the continuation and development of public programs
furthering the arts.
E. To review funding requests and recommend to the City Council the allocation of
public monies to artistic and cultural organizations, individual artists and community
programs.
F. To seek out and encourage contributions and grants to the arts from private and public
sources and to receive and allocate such monies appropriated and/or granted and
donated for such purposes.
ARTICLE VIII
AMENDMENT TO BYLAWS
These Bylaws may be amended by the affirmative vote of two-thirds of the members of the
Commission and the approval of the Eagle City Council, provided that such amendment shall
have first been presented to the membership in writing at a regular or special meeting prior to the
meeting at which the vote is taken
