DAVID NAVARRO / ' ZDDI~;':~IO;~112: 05~E 0 IO~~;(O;; ~ RESOLUTION No. 01-02 A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE UTILITY AND DRAINAGE EASEMENTS ALONG THE SIDE LOT LINES OF LOT 1 AND 2, BLOCK 21 OF BANBURY MEADOWS SUBDIVISION NO.2 AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Banbury Meadows LLC, represented by Roy Johnson, requested a vacation to the final plat of Banbury Meadows Subdivision No.2. The proposed vacation would allow the removal of the utility and drainage easements along the side lot lines of Lot 1 and 2, Block 21; and WHEREAS, On June 19,2000, the Commission passed a motion recommending approval of the vacation, with conditions, to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Idaho Statesman on July 24, and 31, 2000; and WHEREAS, On August 8, 2000, the City Council held a public hearing on the proposed vacation, and voted to approve the vacation with conditions; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications". NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates the utility and drainage easements along the side lot lines of Lot 1 and 2, Block 21 of Banbury Meadows Subdivision No.2 as shown on the attachments hereto, as considered, heard and approved by the Council at its August 8, 2000, public hearing and as shown on the attachments hereto. This Resolution shall be in full force and effect immediately upon its adoption and approval.
