ORDINANCE NO. 68
AN ORDINANCE FOR THE CITY OF EAGLE, ADA COUNTY, IDAHO REREALING ORDINANCE
NO. 20, ESTABLISHING AN EAGLE PLANNING AND ZONING COMMIS~ION, AND
ESTABLISHING AN ORDINANCE DEFINING AND CREATING THE EAGL~ PLANNING AND
ZONING COMMISSION: PROVIDING FOR QUALIFICATIONS OF SAID ~OMMISSION:
PROVIDING FOR THE TERM OF OFFICE, RULES AND ORGANIZATION¡ PRESCRIBING THE
DUTIES OF SAID COMMISSION: PROVIDING FOR MAPS, PLATS ANDREPLATS FOR
EMPLOYEES AND EXPENDITURES: SEVERABILITY AND AN EFFECTIVt DATE. PURSUANT
TO CHAPTER 65, TITLE 67, IDAHO CODE. :
BE IT ORDAINED BY THE EAGLE CITY COUNCIL OF EAGLE, IDAHO!
Section 1. DEFINITIONS
As used in this Ordinance -
"Commission" means the Eagle
created by this Ordinance
"Appointive Members" means all members of the
"Governing Board means the Eagle City Council

Section 2. CREATION OF THE COMMISSION i
The commission shall consist of (from three (3) to tw~lve members).
They shall be appointed by the Mayor and confirmed by a ajority vote
of the City Council. All members must have been residen s of the county
in which they are serving for at least five (5) years, a d must reside
within that county while serving on the commission. Per ons residing within
the Eagle Impact Area shall be entitled to representatio on the Eagle
Planning and Zoning Commission. Such representation sha 1 as nearly as
possible reflect the proportion of population living wit in the City of
Eagle as opposed to the population living within members ip in the Eagle
Impact Area. To achieve such proportional representatio , membership in
the Eagle Planning and Zoning Commission may exceed (12)1 persons. The
term of office for appointive members shall be three (3) years. Said
terms shall be staggered in such a manner that not more han thrity five
person (35%) shall expire in anyone (1) year. All vaca cies shall be
filled in the same manner as original appointments. Mem ers may be
removed after PUBLIC HEARING by a majority vote of the g verning body.
Members shall be selected without respect to political a filiations, and
shall serve without compensation.
Section 3.
RULES-ORGANIZATION AND MEETINGS
The commission shall elect its own chairman, vice-cha.rman, and
secretary and create and fill such offices as it may det rmine necessary
for the proper conduct of the affairs and business of th commission.
Meetings of the commission shall be held when duly calle by the chairman
by written or oral notice. At least one (1) regular meeting shall be
held each month for not less than nine (9) months in a y ar. A majority
of voting members of the commission shall constitute a q orum. All
meetings shall be open to the public. Written rules consistent with this
Ordinance and the laws of the State of Idaho for the tr saction of
business of the commission shall be adopted. Written records of meetings,
hearings, resolutions, findings, studies, permits and actions shall be
maintained and open to the public.
Section 4.
DUTIES
It shall be the duty of the planning and zoning cþmmission to:

Conduct a planning process designed to prepare, implement,
review and update a comprehensive plan that includes all
lands wi thin the governing boards j urisdic!tion;
Hold public hearings prior to recommending the comprehensive
plan, changes to the plan and ordinances, :special use permits,
rezone applications, planned unit develop~ent proposals and
variance applications, and zoning ordinanqe amendments;
Provide ways and means to obtain citizen plarticipation in the
planning process;
Recommend subdivision and zoning ordinanc~s;
Recommend changes to a comprehensive plan ,and zoning ordinance
prior to annexation of an unincorporated ~rea;
Recommend a map, a governing plan and ord~nances for an area
of city impact that is within the unincor~orated area of
a county; and .
Such other duties as are required by Idah~ Code.

EMPLOYEES AND EXPENDITURES
Any expenditures of the commission (exclusive of !gifts) shall be
within the amounts appropriated and set aside by the Ci~y Council for the
commission. Within such limits, the commission is authqrized to hire such
employees and technical advisors as it deems necessary nor the accomplishment
of its authorized purpose and work. .
