MEETING MINUTES
May 14,2024
1. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m.
2. ROLL CALL: Present: GINDLESPERGER,MAY,RUSSELL,KVAMME.A quorum is present.
3. PLEDGE OF ALLEGIANCE: Mayor Pike leads the Pledge of Allegiance.
4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA:
City Attorney Villegas requests that item 12 be moved up on the agenda prior to reports.

5. EXECUTIVE SESSION: 74-206 (1) An executive session at which members of the public are
excluded may be held, but only for the purposes and only in the manner set forth in this section.
The motion to go into executive session shall identify the specific subsections of this section that
authorize the executive session. There shall be a roll call vote on the motion and the vote shall be
recorded in the minutes. An executive session shall be authorized by a two-thirds(2/3)vote of the
governing body. An executive session may be held:
(f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and
legal options for pending litigation, or controversies not yet being litigated but imminently likely
to be litigated. The mere presence of legal counsel at an executive session does not satisfy this
requirement;

6. RECOGNITION:
A. American Eagle Award Presented to Deputy Ryan Vail: The City would like to honor the acts
of bravery and self-sacrifice in the line of duty of Deputy Ryan Vail of the Eagle Police
Department/Ada County Sheriffs Office and present him with the 2024 American Eagle Award.

This will be continued to the next meeting.
7. REPORTS:
A. Mayor and Council: Gindlesperger reports that the Eagle Arts Advisory Committee met,a call to
artists was approved, as was a public art project, and a beautification project for the Eagle Senior
Center. May reports that Matt Stall with COMPASS will be retiring early next year. ACHD got
the intersection opened. May suggests that perhaps in an upcoming Mayor minute an education
piece on the animal control ordinance that was approved. Russell reports on the Conservation
Education Program committee that held a kickoff meeting in April. They elected officers and
identified goals for the committee. They will be meeting every other month for the time being.

Kvamme reports on the Eagle Sewer District meeting, 41,000 linear feet per year. They voted to
increase the monthly fee from $39 to $45 per month per customer. Even with the increase those
fees remain significantly less than several surrounding cities. Mayor Pike held story time at the
Library with young kids. He met with the Eagle High School athletic director and discussed next
year's activities.He has continued to work on the City Hall Emergency Training plan. The second
Saturday Market was held at the City Hall facility and was greatly attended. He encourages people
to support the downtown businesses during this construction downtown.
B. Department Supervisor: Director of Long-Range Planning and Projects,Nichoel Baird Spencer
reviews the deliverables for both staff and elected officials for the May 22nd special meeting. She
also reports on the status of the Eagle Rodeo parking agreement and the conditions contained within
the same.
C. Eagle Police Department: Chief Ruby reviews the monthly statistics for the month of April for
Eagle Police and provides a report on local law enforcement activities.
D. City Attorney:Victor Villegas,City Attorney states that he was contacted by representatives from
Eagle Rodeo,requesting changes to the agreement. However,as City Attorney,he takes direction
from the direction of Council.
8. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS.
Consent Agenda items are considered to be routine and are acted on with one motion. There will be no
separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a
citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from
the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City
Council. Any item on the Consent Agenda which contains written Conditions of Approval from the
City of Eagle City Staff,Planning&Zoning Commission,or Design Review Board shall be adopted as
part of the City Council's Consent Agenda approval motion unless specifically stated otherwise.

F. Development Agreement for RZ-11-23—Oakwood Meadows Subdivision—Buffalo Hump,
LLC:Council authorization for Mayor to execute the development agreement associated with the
rezone from R-E (Residential Estates)to R-2-DA (Residential with a Development Agreement).
The 2.8-acre site is located at the north side West Oakhampton Drive approximately 200-feet east
of the intersection of West Oakhampton Drive and South Mallard Wing Way at 1920 West

G. Findings of Fact and Conclusions of Law for the Approval of RZ-09-23&PP-06-23—Rezone
and Preliminary Plat for Northern Lights Subdivision — Kathleen and Scott Hendricks:
Kathleen and Scott Hendricks, represented by Stephanie Hopkins with KM Engineering, LLP, is
requesting a rezone from A-R (Agricultural-Residential) to R-E-DA (Residential-Estates with a
development agreement [in lieu of a conditional use permit]), and preliminary plat approvals for
Northern Lights Subdivision, a 2-l0 (2-buildable) residential subdivision. The applicant is also
requesting waivers of the sidewalk, front setback of the existing dwelling, and streetlights. The
approximately 4.52-acre site is located at the southeast corner of East Beacon Light Road and

Development, LLC, is dedicating a perpetual, non-exclusive access easement for the limited
purpose of allowing the public to utilize the public trail improvements as noted in the agreement.
Through this agreement, Avimor Development, LLC grants SWIMBA (Southwest Idaho
Mountain Biking Association)a perpetual,non-exclusive easement over the easement area for the
purpose of designing, installing, and maintaining an adaptive trail (public trail improvements)
located within the Avimor Boise County Phase 1 Subdivision. The site is generally located at the

property is not currently contiguous to corporate Eagle City limits; however it is in Eagle's water
service area of impact. The study will only look at whether the City Water Service area could
potentially serve these properties.The findings would not commit the city to providing service,but
to only study the feasibility.

a reimbursement agreement for staff time to review an application that is not contiguous to the city
limits at this time. The landowner is seeking the city's review and approval to investigate the
possibility of a pre-annexation agreement and development agreement similar to what was done
for the Valnova and Fred Meyer projects. The agreement allows the city to recover staff time and
expenses associated with the review.

Russell acknowledges the great partner Avimor is and commends them for their partnership with
SWIMBA for the creation of these trail improvements and dedication of the public access to the
adaptive trail improvements.

with Rennison Design, is requesting a development agreement modification (development
agreement in lieu of a conditional use permit)to modify the conditions of development and concept
plan contained within the executed development agreement.The 15.55-acre site is generally located
on the east side of South Edgewood Lane between East State Street and State Highway 44. (MG)

Debra Nelson, representing the applicant, states that the applicant wishes to lodge an objection.
They have filed something in writing and have not been provided with an opportunity to present.
Gindlesperger states that this request has nothing to do with the named tenant Chick-Fil-A but is
related to her concerns with the traffic entering and exiting the site. She would like to direct staff
to work with the applicant to bring back a site plan that has possibly removing one of the drive
thrus, lowering some of the densities of those drive thrus, and address the concerns that Council
has expressed regarding landscape buffering and design; these elements should be addressed at a
future public hearing.
Discussion.
City Attorney Victor Villegas recommends that another hearing would be appropriate because of
the changes requested to the development agreement.
Gindlesperger moves regarding item 9A1 to direct staff to have another public hearing
noticed up for this item at a future date, and to work with the applicant to bring back the

Architecture and New Building Elevations as Part of the Development Agreement
Modification for East End Marketplace — TPC Commercial, LLC: TPC Commercial, LLC,
represented by Zach Turner with Rennison Design, is requesting a development agreement
modification(development agreement in lieu of a conditional use permit)to modify the conditions
of development and concept plan contained within the executed development agreement. The
15.55-acre site is generally located on the east side of South Edgewood Lane between East State
Street and State Highway 44. (MM)

D. Dog License Fees: Staff is seeking Council direction for dog license fees for one- and two-year
licenses so that a public hearing can be noticed for the new or changed fees. (TEO)

City Clerk Tracy Osborn reviews current license fees, and those of surrounding cities. Staff is
seeking direction on fees for one-and two-year licenses for the legal notice of a public hearing.
The council concurs to move forward with the recommended fees as presented by staff.
10. PUBLIC HEARINGS: ALL PUBLIC HEARING ITEMS ARE CONSIDERED ACTION ITEMS.
Public hearings will not begin prior to 6:00 p.m. Public Hearings are legally noticed hearings required
by state law. The public may provide formal testimony regarding the application or issue before the
City Council. This testimony will become part of the hearing record for that application or matter.
Public hearing testimony time limits: Individuals testifying are allotted three (3) minutes for non-
repetitive testimony Disclosure of ex parte and/or conflict of interest.

Mayor Pike opens public testimony.
Joannie Anderson, 2880 N. World Cup, Eagle, Idaho. Ms. Anderson lives in this subdivision and
has adhered to the standards of it. This builder should be required to do the same;the structure in
question is an eye sore to the subdivision. Biltmore should be required to adhere to the subdivision
standards, which they themselves established. It distracts from the overall ambiance of the
subdivision.
Mike McKenna, 5771 W. Pulaski St. Eagle, Idaho. Mr. McKenna feels that Biltmore knew the
setback was wrong and yet proceeded. He believes that the subdivision is a great community,and
that Biltmore should be held accountable. Several people have submitted letters supporting the
denial of their request.
Katie Mendosa, 2879 N. Roja Place, Eagle, Idaho. Ms. Mendosa states that the house is just off
the entry of the subdivision, and it is unsightly. The proximity to the sidewalk is far too close.
Biltmore should be required to follow the rules that apply to the other residents.
Bill Thorson 5809 Triago Drive, Eagle,Idaho. Mr. Thorson feels the applicant is being dishonest.
When the foundation was cut in,they had to know there was an issue on day one. In addition, he
is concerned if this is allowed it may impact the ability for CC&R to be enforced.
Darrell D. Scott Smith, 2006 S. Rivington Way, Eagle, Idaho. Mr. Scott Smith rides his bike in
this area and sometimes travels through this subdivision. While the applicant stated that the quality
of life of the immediate neighbor was not impacted, Mr. Scott Smith believes that the immediate
neighbor does bear the brunt of the impact,but the entire subdivision must live with the impact as
well.

Jason Poulsen rebuts the testimony.Mr.Poulsen makes note that City Staff approved the plans and
confirmed the footing setbacks during inspections. He discusses the permitting and communication
process during the construction process. Poulsen discusses the proximity to the street of the
structure in question.

Discussion amongst the Council.
May thanks those that submitted written testimony. May expresses concern that it was the actual
developer that did not follow the setbacks who should have had a more intimate knowledge of the
subdivision than a builder not associated with the development. She is not inclined to vote in favor
of the waiver. Gindlesperger concurs that she is not inclined to grant the waiver. Russell notes that
the overwhelming testimony was the proximity to the street, however the issue before Council is
the side setback;with that being said,she concurs with May and Gindlesperger. Kvamme believes
there is a quality control issue with Biltmore. Kvamme states that an alternate compliance may be
viable,but unless that could be agreed upon,he would not be in favor of the modification.

Subdivision — Madera Development, Inc.: Madera Development, Inc., represented by Jon
Breckon and Gregg Davis with Breckon Land Design, is requesting an annexation, rezone from
RUT (Rural-Urban Transition — Ada County designation) to R-3-DA (Residential with a
development agreement [in lieu of a PUD]), and preliminary plat approvals for Headquarters
Subdivision,a 23-lot(20-buildable,3-common)residential subdivision. The 10-acre site is located
on the south side of West Floating Feather Road at the southwest corner of West Floating Feather
Road and North Lanewood Road at 5655 West Floating Feather Road.(MJW)

John Breckon rebuts the testimony. The developer is agreeable to wrapping the berm to provide
more shielding of the pump house or taking other mitigation efforts to address the noise impact.

B. ACTION ITEM.- Discussion Regarding Adopting a Rules of Civility, Rules of Decorum at
Public Meetings Ordinance.(VV)
Mayor Pike introduces the item.
City Attorney Victor Villegas discusses Sandpoint,Idaho's ordinance pertaining to rules of civility
and decorum for public meetings.
Discussion amongst the Council.
Russell states that she had attended a training put on by the Association of Idaho Cities. They
recommended that cities adopt these types of guidelines to encourage decorum at public meetings.
Kvamme cites a Supreme Court decision in 1964 and questions if it has been reviewed to ensure
compliance with that case.
Discussion.
Russell moves to direct staff to work with the City Attorney to draft a proposed ordinance to address
decorum.
12. PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding
concerns or comments they would like to provide to the City Council regarding any matter, up to and
including any subject on the agenda with the exception of Public Hearing and land use items.Comments
regarding Public Hearing and land use items need to be made during the open public hearing for said
item(s) in accordance with Idaho Code. At times, the City Council may seek comments/opinions
regarding specific City matters(excluding Public Hearing and land use items)during this allotted time.
Out of courtesy for all who wish to speak,the City Council requests each speaker limit their comments
to three(3)minutes.
Mike Gallegos, 3664 W. Temple Dr., Eagle, Idaho. Mr. Gallegos is requesting an amendment to the
parking lot agreement for the Rodeo. He details several items he would like the Council to alter in the
agreement,inquires perhaps if a special meeting could be held to discuss the matter.If the matters aren't
addressed the Rodeo Board may have to cancel the rodeo.
Matt Woodington,8382 Foothills Rd.,Middleton,Idaho.Mr.Woodington reminds the Council that the
Eagle Rodeo is run by volunteers,and he feels that the conditions that the City has put on are excessive.
They would request that an additional meeting be held to address their concerns.
Manuela Walters, 1327 N.Konia, Eagle,Idaho. Tomorrow is Police Officers Memorial Day and flags
will be flown at half-staff. She thanks Chief Ruby for his service.
Carol Venable, 1230 N. Hiltonhead,Eagle,Idaho. Ms. Venable is very upset that the Rodeo has been
held up by the City with this last-minute decision. She is very disappointed in the decisions that have
been made tonight. She would prefer the Council to hear public comments at the beginning of the
meeting.
Lori Reddick, 536 Mango Drive Eagle,Idaho.Ms.Reddick feels that the conduct of the Council earlier
in the Council meeting was unlawful and possibly set the City up for a lawsuit. She also feels that
Council is despicable.
D. Scott Smith, 2006 S. Rivington Way, Eagle, Idaho. Mr. Smith comments that he appreciates the
rodeo and what they do, and hopes it goes through.
