Minutes - 2024 - City Council - 04/23/2024 - Regular EAGLE CITY COUNCIL MEETING MINUTES April 23,2024 1. CALL TO ORDER: Mayor Pike calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: MAY, RUSSELL, KVAMME, Absent: GINDLESPERGER. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Pike leads the Pledge of Allegiance. 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: NONE 5. RECOGNITION: A. American Eagle Award Presented to Deputy Ryan Vail: The City would like to honor the acts of bravery and self-sacrifice in the line of duty of Deputy Ryan Vail of the Eagle Police Department/Ada County Sheriffs Office and present him with the 2024 American Eagle Award. (BKP) Deputy Vail was unable to attend. In light of the recent tragedy in which Ada County Sheriff Deputy,Tobin Bolter lost his life in the line of duty,Mayor Pike asks that we hold a moment of silence in his honor. Chief Ruby speaks about the recent tragedy and the impact on the Sheriff's Office,First Responders and the community as a whole. Chief provides an overview of Deputy Bolter's law enforcement career. Both the Sheriff's Office and the Deputy Bolter's family have received a great deal of support from the community,and it is truly appreciated. 6. PRESENTATION: A. Valley Regional Transit(VRT)will Provide an Update on 160 OnDemand Ridership and FY024 Service Chance Roll Out. Mayor Pike introduces the item. Kate Doll, Principal Planner with Valley Regional Transit gives a report on local activities. Ms. Doll reviews the Eagle 160 OnDemand Service, Beyond Access program, and fiscal year 2024 service change updates. On June 3, 2024, there will be a number of service changes addressed, they are utilizing a variety of communication methods to get the information out to riders. Kyle Street reviews the budget timeline for Valley Regional Transit. In the next two weeks an assessment notice will be sent out for budgeting purposes. These numbers are generally incorporated in the annual cooperative agreement. Representatives from VRT would be available in June or July for any budget workshops. Council President Russell comments on what a great service the Beyond Access program is for those 60 and older or disabled and that they can ride for free. The hours are 8:00 a.m.to 5:00 p.m. Kvamme is impressed with the methods utilized to increase ridership and routes, as well as the communication methods being utilized. 5. REPORTS: A. Mayor and Council: May states that the last Thursday of the month ACI-D has their pop-up event in the Albertson's parking lot. She attended the COMPASS Board meeting, visited the Page 1 K:\COUNCIL\MINUTES\Temporary Minutes Work Area\CC-04-23-24min.docx downtown businesses, and attended a tour of the ACSO Dispatch Center. Russell would like to have a strategic planning session to discuss staff capacity and the goals and projects each Council member has identified to discuss prioritization. She would like a list generated by each Department Head of what duties are identified by Idaho State Code, City Code and a list of ongoing projects. May concurs with the suggestion, she would like the meeting conducted in a workshop session in a round table setting. Kvamme also agrees. Mayor Pike states he would like to try and get something scheduled within the next two weeks. Kvamme reports on the upcoming Eagle Sewer District meeting, where they will be addressing fees. Mayor Pike states he also attended the tour of Dispatch for National Communications Week.It was a great way to celebrate what they do. He also attended the COMPASS Board and a meeting with the American Legion. He was on a mayoral panel for the Idaho Apartment Association.There are monthly interfaith group meetings being held. Spring Fling was held on April 20th and it was a great turn out by the community. A shout out to City Staff for the hard work they put into the event. He held a Coffee with the Mayor meeting for the downtown businesses to discuss transportation challenges they are facing. B. Department Supervisor: Director of Long-Range Planning and Projects provides the population estimated that was recently generated by COMPASS which is 37,550. C. Eagle Police Department: Chief Ruby reviews the monthly statistical report and local enforcement activities. D. City Attorney: None 6. CONSENT AGENDA:ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with one motion.There will be no separate discussion on these items unless the Mayor,a Councilmember,member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. The 2.4-acre site is located on the northeast corner of North Stierman Way and East Civic Lane at 100 North Stierman Way.(BAW) D. DR-2023-66—Parkinson Multi-tenant Flex Space Building—Urban LLC:Nick Louie with Urban LLC is requesting design review approval for a 12,332-square foot,6-unit,multi-tenant flex space building. The 0.74-acre site is located on the northwest corner of East State Street and South Parkinson Street at 1093 South Parkinson Street (Lot 19 and 20, Block 1, Randall Acres Subdivision No. 15).(ERF) E. DR-2023-67—Master Sign Plan for Parkinson Multi-tenant Flex Space Building—Urban LLC: Nick Louie with Urban LLC is requesting design review approval for the master sign plan for a multi-tenant flex space building. CivicRec Agreement: Staff is seeking Council approval of the renewal of an agreement between the City of Eagle and CivicRec for scheduling and registration software used by the Recreation Department. (HSD) Mayor Pike introduces the item. Kvamme notes that while this was approved some time ago,the density is of concern. Specifically, that it is an approval for of 123 buildable lots with this final plat. Kvamme believes that the density is too high for something that far outside of the City center and hopes future projects would take that into consideration. Deputy Planning and Zoning Administrator Mike Williams states that the development agreement for original approval was in 2007, and at that time it was designated as the Village Center in the Comprehensive Plan. ACTION ITEM: Eagle Rodeo Lease Agreement - Amendment No. 1: Approval of an amendment to the lease agreement with the Eagle Rodeo, Inc for the 10-acre located at 8660 West Equest Lane. (NBS/VV) Mayor Pike introduces the item. City Attorney,Victor Villegas states that the original direction was for staff to draft an amendment to the lease agreement to allow use of the electricity at the house. However,after discussions with the City Building Official,the alterations to the homes electrical panel had never been inspected. With the City being unable to confirm the quality and safety of the work that had been done, he was not comfortable drafting an agreement until that panel has been brought back into compliance Page 4 K:\COUNCIL\MINUTES\Temporary Minutes Work Area\CC-04-23-24min.docx in order to ensure the safety of the users. Therefore, an agreement was not prepared for Council consideration tonight. Mayor Pike seeks a motion to direct the attorney to fulfill the need for amendment 9A for the Eagle Rodeo lease. Eagle Rodeo Lease Parking Agreement: Approval of a Parking Agreement for the Eagle Rodeo Inc. for the 2024 Eagle Rodeo. (NBS/VV) Mayor Pike introduces the item. Director of Long-Range Planning and Projects, Nichoel Baird Spencer reviews the draft parking lease agreement. The agreement adds the barn for use for storage only to the agreement,it requires the submittal of an electrical permit for the work that was done in the barn,requires a permit bond vs a performance bond $460,000, attendance ticket sales will be capped at 4,500 each night with no sales allowed on Saturday. There is no use of the barn except for personnel storage only. Discussion and review of other sections within the agreement. Ms. Hopkins reviews the rezone and preliminary plat applications. They are requesting the waiver of landscaping and streetlights along Beacon Light Road. Deputy Planning and Zoning Administrator, Mike Williams reviews the staff report and areas for special consideration. Mayor opens public testimony. No one chooses to speak. ACTION ITEM: Ordinance 922-Animal Control Ordinance: An Ordinance repealing Title 4 "Public Health and Safety", Chapter 5 "Animal Control and enacting a new City of Eagle Code Title 4,Chapter 5,entitled the City of Eagle Animal Control Ordinance;for severability;providing for codification; and providing an effective date. (HNC/TEO) Mayor Pike introduces the item. Deputy Clerk, Holly Csencsits reviews the history of the ordinances and provides an overview of the ordinance for Council consideration. Russell asks when other agencies adopted their license fees. May would like further clarification on the leash law and would like it clarified.Kvamme appreciates the work by staff but has concerns that if a member of the Committee believes there should be a public hearing and would like clarification on that matter. Villegas states that these types of ordinances do not require public hearing,however if the Council would like to take public comment, they could table the item and notice for public comment at another date. Kvamme discusses the desire to have the opportunity to have the committee's concerns addressed. Discussion regarding options for moving forward. The 36.18-acre site is located on the south side of West Floating Feather Road approximately 500-feet west of the intersection of North Cove Colony Way and West Floating Feather Road. Seconded by May. Discussion. Russell withdraws the motion to approve 921. Seconded concurs. Discussion regarding changes desired to the proposed ordinance including clarifying the term of Seat 1 with annual review of that appointment, the establishment of a re-appointment policy and term limits. May would like clarifying language regarding the term of Seat 1 added. Seat 1: Seat 1 shall be filled by either a City Council Member or the Mayor. The term of office for the designee will be for one calendar year.The individual will be identified and confirmed by the City Council annually at the first regular meeting of the calendar year. The resignation or removal of the Mayor or a City Council Member shall also terminate membership on the Agency Board. An Urban Renewal Agency Commissioner may resign his/her seat on the Agency Board without resigning his/her position as Mayor or City Council Member. Discussion. Russell states that after researching best practices for non-profit boards, she has crafted language she would like to see incorporated into the ordinance. The additional would read: Re-appointments and Term Limits: Individuals who wish to serve a consecutive term are required to submit a Request for Consideration application in order to be considered. A news release is not required for a consecutive term reappointment. However, once an individual has served two (2) consecutive three-year terms, or(3)consecutive two-year terms they will not be permitted to serve again and a news release announcing the vacancy shall be required at the expiration of the said term of service. Appointments to fill a vacancy for a partial term shall not count against that seat's term limit if the appointment is for a period of less than twenty-six(26)weeks or six(6)months. Discussion. Russell directs staff to add the additional amendments to ordinance#921 and bring back as soon as possible to a Council meeting. Seconded by May. ALL AYE...MOTION CARRIES. E. ACTION ITEM: Discussion Regarding the Eagle Industrial Development Corporation: Council Member Kvamme would like to discuss the viability of retaining or eliminating the Corporation. (CK) Mayor Pike introduces the item. Council Member Kvamme discusses the Industrial Development Corporation. He has had discussions with the President of the Industrial Development Corporation. He is of his option if it is not contributing there is no need for it to be retained. Kvamme directs staff to confirm the requirements are in place that would allow the Industrial Development Commission to be dissolved and if confirmed that staff bring forward an ordinance dissolving the Industrial Development Corporation. Ms. Bloom is concerned with the trucking traffic Beacon Light Road. She has reached out to the trucking company to no avail, and she has been personally harassed. She appreciates the efforts of Chief Ruby but recognizes that the police department is too busy to do enforcement. Bob Van Arnem, Eagle, Idaho. First he thanks the Council for passing ordinance #922. He was concerned that an impression would be given that the committee's recommendations were unanimous. She is concerned that the public was not allowed to speak to the animal control ordinance. Ms. Kimson has concerns with the definition of service and companion animals. RECITALS WHEREAS, City is the owner of certain real property located on 8660 W. Equest Lane, 8400 Equest Lane and 4490 N. Highway 16 Eagle, Idaho (the "Property"). WHEREAS, City is desires to provide User with a revocable and nonexclusive license to use certain portions of the Property as a parking lot as well use of the Barn related to User's rodeo activity on the terms and conditions as contained herein. AGREEMENT NOW, THEREFORE, for and in consideration of the covenants and obligations contained herein and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto hereby agree as follows: 1. Incorporation of Recitals: The above Recitals are a material part of this Agreement and are incorporated into the Services of this Agreement by reference as though they were fully set forth herein. 2. Grant of License for Parking: City grants to User permission to use the areas identified and depicted in Exhibit A as Parking Lot A, Parking Lot B, and Parking Lot C(collectively the"Marked Parking Areas") for the sole purpose of providing parking during User's Rodeo event scheduled on June 5, 6, 7, and 8, 2024 (the "Rodeo Event"). The license granted herein is non-exclusive, non-transferable, and subject to all rights of the City. 3. User's Obligations Prior To Rodeo Event: User will do the following prior to the Rodeo Event: a) User shall erect and have in place during the days of User's rodeo a temporary fence along the eastern and southern parking area of the Property generally identified and depicted in Exhibit B attached hereto. User shall ensure that the temporary fencing complies with all Federal, State and local regulation including, but not limited to, Eagle City Code. User will have the temporary fencing erected no later than May 24,2024. The temporary fencing is to be removed no later than June 21, 2024. b) User shall obtain and provide the City with a copy of all approvals and permits from Idaho Transportation Department, Star Fire District, Eagle City Police, and City of Eagle ("Agency")approving User's rodeo event and parking. Approvals must be received by the City no later than May 8, 2024, unless additional time is requested by an Agency. If User fails to provide an approval and/or permit from an Agency, this Agreement shall PARKING LICENSE AGREEMENT-1 automatically terminate and any license granted under this Agreement shall be deemed rescinded by the City. c) User will provide City with a signage plan marking areas where signs reading"Rodeo Full" will be displayed notifying the public of the status of the parking lot.The signage plan shall be submitted to the City no later than May 8, 2024. d) User will cause to have repaired all unpermitted electrical modification(s) on or near the house and Barn structures that were done last year by User and return them to the original condition. User shall submit for an electrical permit and receive all required inspections and approvals. e) User will meet with City and Agency representatives on the Property daily during the Rodeo Event at 11:00 a.m. to discuss matters such as traffic control, traffic enforcement attendance, and Property use issues. 4. Traffic Control and Signage: User will be responsible for the placement and maintenance of adequate signage at the entrance to the Marked Parking Areas. User shall mark off rows for parking using a T-Post, twine and flags. Further, during and at the conclusion of each day of the Rodeo event, User will provide trained personnel to direct traffic in and out of the Marked Parking Areas. 5. User's Obligations After Rodeo Event: After to the Rodeo Event, User will do the following: a) At the end of User's rodeo event, User shall grade, repair, and otherwise restore the Property in a condition that will comply with Eagle City Code Title 11 A's hillside and grading standards as well as comply with the City's floodplain permit. b) User will submit an engineering report from an Idaho licensed engineer to the City engineer setting forth compliance with Title I 1 A's hillside and grading standards and floodplain permit. c) User, City and Agency representatives will meet at the Property no later than two weeks after the Rodeo Event to conduct a post event meeting. 6. Bonding: User shall obtain and maintain during the term of this Agreement a pe permit bond in the amount of$460,000 Dollars to ensure User's obligation to perform Paragraph 5(a)and (b)above. The bond shall be in a form acceptable to the City and issued by a surety licensed to do business in the State of Idaho. User shall deliver the bond to the City on or before May 8, 2021 May 24, 2024, or prior to commencing work. 7. Grant of License to Barn: During the term of this Agreement, User is permitted to store its personal property such as tools, vehicles and equipment in the Barn. Further, City permits User to use the electricity in the Barn for any purpose incidental to the storage of User's equipment such as charging User's radios. Use of electricity in the Barn shall be for no other purpose. Prior to using the electricity in the Barn, User must first comply with Paragraph 3(d) above. PARKING LICENSE AGREEMENT-2 8. Attendance& Ticket Sales: User will cap attendance at 4,500 per night and will not have gate ticket sales on Saturday night. 9. Term of Agreement: The term of this Agreement shall commence on the date of the last signature on this Agreement and shall expire on September 1, 2024. 10. No Bailment: Notwithstanding any other provision hereof,the parking of vehicles in the Marked Parking Areas and the storage of User's personal property in the Barn shall not create a bailment between City and the owner of any vehicle parked in the Marked Parking Areas and City shall not be responsible for loss or damage occurring on or about the Marked Parking Areas to automobiles, vehicles or accessories, or the contents thereof, caused by theft, collision, water, wind storm or any other causes whatsoever. Further,User's personal property stored in the Barn shall be at the sole risk and loss of User and City shall have no responsibility or liability for any loss or damage to User's personal property caused by theft, collision, water, wind storm or any other causes whatsoever. 11. No Alternations By User: User shall make no alterations, additions or improvements to the Property nor any structure located on the Property other than those approved by the City in writing. 12. Ri2ht of Entry: City reserves the right to enter the Property at all reasonable hours for the purpose inspecting the condition of the Marked Parking Areas and associated roadways leading to those areas as well as inspection of the Barn. 13. Assi2nment or Subletting: This Agreement may not be assigned or subleased without the express written consent of the other Party. 14. Insurance: User shall at its own expense obtain and maintain general liability insurance with aggregate policy limits of at least one million dollars which covers the Marked Parking Areas during the term of this Agreement. The general liability insurance policy shall name City as an additional insured. Within ten(10) days of the Parties' execution of this Agreement, User shall provide City with a certificate of insurance or other proof of insurance evidencing User's compliance with this Paragraph 14. 15. Indemnity: User hereby agrees to protect, defend, indemnify and hold harmless the City from and against any and all liabilities, costs and/or expenses including, without limitation, reasonable attorneys' fees, in connection with damages, losses, injuries, and/or death to persons which may be asserted against City, City's employees, representatives, and/or agents, arising out of or in relation to the use of the Marked Parking Areas by User except to the extent (if any) such liabilities, costs or expenses are caused by, arise out of, result from or relate exclusively to City's own negligence or intentional misconduct. 16. Notice. Construction of Agreement: This Agreement shall not be construed for or against any party based upon its preparation,but shall be construed as if all Parties,and each of them,jointly prepared it, and any uncertainty or ambiguity shall not be interpreted against any one party. 21. Severability: If any provision of this Agreement shall be invalid,illegal,or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be impaired or affected in any way. Further, the Parties agree that those provisions, if any, found to be invalid, illegal or unenforceable,shall be modified by the Court,to conform to the most expansive permissible reading under the law. 22. Approval: The Parties each acknowledge that this Agreement, even though agreed upon by City's representatives, is not binding upon the City until such time as the Eagle City Council approves this Agreement and authorizes the Mayor to execute this Agreement on behalf of the City of Eagle.
