SUMMARY OF ORDINANCE NO. 90 OF THE CITY OF EAGLE, IDAHO Ordinance No. 90 of the City of Eagle, Idaho, grants a 30 year fran- chise to Intermountain Gas Company for the construction, maintenance and operation of a natural gas transmis- sion and distribution system within the present and future city limits of Eagle. The Ordinance provides that. Inter- mountain Gas will obtain a that, from the City for openings,in streets and alleys, subjects Intermountain Gas to all regulatory powers of the City, allows the City access to all plans, accounts and records of Inter- mountain Gas relating to its opera- tions within the City, establishes a franchise fee equal to three percent (3%) of the gross receipts of Inter- mountain Gas for sales of gas within the City, provides for indemnification to the City by Intermountain Gas for any losses incurred as a result of _ claims and sults filed against the City arising out of the gas distribution sys- tem in the City, and requires Inter- mountain Gas to provide the City with proof of liability and bodily injury in- - surance in stated amounts.
