SUMMARY OF ORDINANCE NO. 90
OF THE CITY OF EAGLE, IDAHO
Ordinance No. 90 of the City of Eagle, Ida 0, g ant a 30
year franchise to Intermountain Gas Company for the ons ruction,
maintenance and operation of a natural gas tran miss'on nd dis-
tribution system within the present and future ity imi s of
Eagle. The Ordinance provides that Intermounta'n Ga wi I obtain
a permit from the City for openings in streets nd a ley, sub-
jects Intermountain Gas to all regulatory power of he ity,

Ordinance No. 90 of the City of
Eagle, Idaho, grants a 30 year fran-
chise to Intermountain Gas Company
for the construction, maintenance and
operation of a natural gas transmis-
sion and distribution system within the
present and future city limits of Eagle.
The Ordinance provides that. Inter-
mountain Gas will obtain a that,
from the City for openings,in streets
and alleys, subjects Intermountain
Gas to all regulatory powers of the
City, allows the City access to all
plans, accounts and records of Inter-
mountain Gas relating to its opera-
tions within the City, establishes a
franchise fee equal to three percent
(3%) of the gross receipts of Inter-
mountain Gas for sales of gas within
the City, provides for indemnification
to the City by Intermountain Gas for
any losses incurred as a result of _
claims and sults filed against the City
arising out of the gas distribution sys-
tem in the City, and requires Inter-
mountain Gas to provide the City with
proof of liability and bodily injury in- -
surance in stated amounts. The Ordi-
nance also requires Intermountain
Gas to comply with all safety regula-
tions of the City or anY appropriate
regulatory body, provides that the City
will not compete with Intermountain
Gas during the term of the franchise,
establishes provisions for the early
surrender of the franchise by inter-
mountain Gas, provides for written ac-
ceptance of the franchise by Inter-
mountain Gas, requires the City's con-
sent for the sale, assignment or lease
of the franchise, provides for the pay-
ment of publication costs- by Inter-
mountain Gas, establishes a forfeiture
procedure for failure to perform any
terms of the franchise and provides a
severabilityclause.
