AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, ANNEXING
REAL PROPERTY TO THE CITY, DESIGNATING THE ANNEXED TERRI'
COMMERCIAL, PROVIDING FOR THE FILING OF THE ORDINANCE
CITY CLERK AND PROVIDING FOR A SEVERABILITY CLAUSE
EFFECTIVE DATE.
BE IT ORDAINED by the Mayor and City Council of the C

SECTION 1. ANNEXATION OF CONTIGUOUS LAND. The fol

SECTION 2. APPLICABLE ORDINANCES. From and afte
effective date of this ordinance, all property and persons w
the limits of the above-described annexed real property sha
subject to the provisions of all by-laws and ordinances o
City of Eagle, Idaho.
SECTION 3. ZONING OF ANNEXED LAND. The above-desc
real property is hereby designated as zoning district
(Service Business District) and all maps of the City of
shall be amended to reflect such designation.
SECTION 4. FILING OF ANNEXATION ORDINANCE. The City
Clerk, within ten (10) days of this ordinance, shall file a
certified copy of this ordinance with the Ada County Auditor, Ada
County Treasurer, Ada County Assessor and the Idaho State Tax
Commission and shall further comply with the provisions of
§63-2215, Idaho Code, regarding preparation and filing of a map
and legal description of the real property annexed herein.
SECTION 5. SEVERABILITY. The provisions of this Ordinance
are hereby declared to be severable and if any provisions of this
ordinance or the application of such provision to any person or
circumstance is declared invalid for any reason, such declaration
shall not affect the validity of the remaining portions of this
ordinance.
SECTION 6. EFFECTIVE DATE. This ordinance shall become
effective upon its passage, approval and publication in the
manner provided by law.
PASSED by the City Council and APPROVED by the Mayor this

SUMMARY OF ORDINANCE NO. 108
Ordinance No. 108 of the City.of Eagle, Idaho, annexes certain
real property to the City, designates the annexed territory as
commerical and provides for the filing of the ordinance by the
City Clerk, provides for an effective date and contains a severabil-
ity clause.
Section 1. of Ordinance No. 107 reads in full as follows:
