ORDINANCE NO. 1(4
AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, REPEALING ORDINANCE
NO. 111 AND ANNEXING CERTAIN REAL PROPERTY TO THE CITY,
DESIGNATING A PORTION OF THE ANNEXED TERRITORY AS COMMERCIAL, A
PORTION RESIDENTIAL AND A PORTION AGRICULTURAL, PROVIDING FOR THE
FILING OF THE ORDINANCE BY THE CITY CLERK AND PROVIDING FOR A
SEVERABILITY CLAUSE AND AN EFFECTIVE DATE.
BE IT ORDAINED by the Mayor and City Council of the City of
Eagle, Ada County, Idaho:
SECTION 1. That Ordiance 111 of the City of Eagle, Idaho,
be and the same is hereby repealed.
SECTION 2. ANNEXATION OF CONTIGUOUS LAND. The real
property, as specifically described in Exhibit "A" attached hereto
and incorporated by reference as if set forth in full herein and
lying contiguous to the City of Eagle, is hereby annexed to and
made a part of the City of Eagle.
SECTION 3. APPLICABLE ORDINANCES. From and after the
effective date of this ordinance, all property and persons within
the limits of the above-described annexed real property shall be
subject to the provisions of all by-laws and ordinances of the
City of Eagle, Idaho.
SECTION 4. ZONING OF ANNEXED LAND. Parcel 1 of the
above-described real property is hereby designated as zoning
district R-5 (Residential), Parcel 2 of said property is hereby
designated as zoning district C-3 (Service Business District) and
Parcel 3 of said property is hereby designated as zoning district
A (Agricultural) and all maps of the City of Eagle shall be
amended to reflect such designation.
SECTION 5. FILING OF ANNEXATION ORDINANCE. The City Clerk,
within ten (10) days of this ordinance, shall file a certified
copy of this ordinance with the Ada County Auditor, Ada County
Treasurer, Ada County Assessor and the Idaho State Tax Commission
and shall further comply with the provisions of §63-2215, Idaho
Code, regarding preparation and filing of a map and legal
description of the real property annexed herein.
SECTION 6. SEVERABILITY. The provisions of this ordinance
are hereby declared to be sever.able and if any provisions of this
ordinance or the application of such provision to any person or
circumstance is declared invalid for any reason, such declaration
shall not affect the validity of the remaining portions of this
ordinance.
SECTION 7. EFFECTIVE DATE. This ordinance shall become
effective upon its passage, approval and publication in the manner
provided by law.

CITY OF EAGLE, IDAHO - ANNEXATION ORDINANCE NO. 114
Summary Published October 16, 1986
I, Carlyle W. Briggs, P.E., a Professional Engineer and Land Surveyor, licensed
by the State of Idaho, do hereby certify that I prepared the legal land description
for the annexation of the Holgate Enterprises, Inc. land area described in
the City of Eagle, Idaho, Ordinance No. 114, as filed with the City Clerk's
records for the City of Eagle, and that since the day of filing, the typographical
errors have been discovered. This affidavit is for the purpose of correcting
the errors, and requesting the Eagle City Clerk and others to file and reference
the attached corrected description to the said Ordinance No. 114. Copies of
this affadavit are being furnished to all those who were furnished ordinance
copies.
The necessary corrections in the Ordinance description of land being annexed
are as follows:
