AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, AMENDING ORDINANCE NO.
113, ADOPTED BY THE EAGLE CITY COUNCIL ON SEPTEMBER 9, 1986, TO
CORRECT THE LEGAL DESCRIPTION OF THE REAL PROPERTY ANNEXED TO THE
CITY OF EAGLE BY ORDINANCE NO. 113, AND PROVIDING EFFECTIVE DATE.
WHEREAS, the City of Eagle, Idaho (the "City"), is a
municipal corporation organized and operating under the municipal
laws of the State of Idaho and is authorized to annex to and
incorporate within the boundaries of the City contiguous real
property; and
WHEREAS, by the enactment of Ordinance No. 113, duly
passed by the City Council and approved by the Mayor on September
9, 1986, the City, in accordance with the procedures required by
law, duly annexed certain contiguous real property to the City;
and
WHEREAS, the legal description of the property so
annexed by Ordinance No. 113 inadvertently omitted a parcel of
property intended to be included in said annexation, and the Mayor
and Council desire to correct said legal description to include
the parcel inadvertently omitted; and
WHEREAS, no additional consents, hearings, or other
procedural steps are required as a condition precedent to the
amendment of Ordinance No. 113 to correct said legal description.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL
OF THE CITY OF EAGLE, IDAHO, as follows:
Section 1: Ordinance No. 113, adopted by the Eagle City
Council and approved by the Mayor on September 9, 1986, is hereby
amended by including in Exhibit "A," attached to said Ordinance
No. 113 and incorporated therein by reference in Section 1 of said
Ordinance No. 113, the following described real property, all
situate in the Southeast Quarter (SEI) of Section 18, Township 4
North, Range 1 East, Boise Meridian, Ada County, Idaho:
Beginning at the Southeast Corner of Section
18, T4N, R1E, B.M.; thence North 00° 36' 29"
East 474.83 feet along the east line of the
Southeast Quarter of said Section 18 to a
point; thence North 90° 00' 00" West 675.73
feet to a point on the North bank of the South

Channel of the Boise River, which is the TRUE
POINT OF BEGINNING;
thence along said North bank of the Boise
River South 83° 54' 00" West 296.34 feet to a
point;
thence South 71° 52' 00" West 132.00 feet to a
point;
thence South 58° 07' 00" West 66.00 feet to a
point;
thence South 01° 52' 00" West 159.29 feet to a
point on the South bank of the South Channel
of the Boise River (which point is described
on Instrument No. 8528817, Records of Ada
County, Idaho);
thence along said South Bank North 22° 44' 00"
East 85.83 feet to a point;
thence North 72° 53' 00" East 287.00 feet to a
point;
thence South 86° 06' 00" East 170.54 feet to a
point;
thence North 01° 52' 00" East 114.67 feet to
the TRUE POINT OF BEGINNING;
Containing 1.134 acres, more or less.
Section 2: In accordance with the Comprehensive Plan of
the City, the property described in Section 1 hereinabove is
hereby zoned "A" or Agricultural District under the Zoning
Ordinance of the City, and the Official Zoning Map of the City
shall reflect such designation.
Section 3: All other provisions of Ordinance 113,
except as provided herein, are hereby ratified and confirmed.
Section 4: The City Clerk is hereby authorized and
directed, within ten (10) days of the adoption of this Ordinance,
to file certified copies of this Ordinance with the Ada County
Auditor, the Ada County Treasurer, the Ada County Assessor, and
the Idaho State Tax Commission, all as provided by Section 50-223,
Idaho Code, and to comply with the requirements of Section 63-
2215, Idaho Code, as to the filing of a legal description and map.

Section 5: This Ordinance shall take effect and be in
force from and after its passage, approval, and publication.
