AN ORDINANCE ENACTING A NEW CHAPTER lE UNDER TITLE 7, EAGLE CITY
CODE, PROVIDING SHORT TITLE AND PURPOSE; PROVIDING FOR
DEFINITIONS; REQUIRING PERMITS FOR THE INSTALLATION OF SOLID FUEL
HEATING APPLIANCES; PROVIDING FOR THE ISSUANCE OF SUCH PERMITS;
AND ESTABLISHING A PENALTY FOR NONCOMPLIANCE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO:
Section 1: That a new Chapter 7-1E under Title 7, Eagle
City Code, be, and the same is hereby enacted to read as follows:
7-1E-1: SHORT TITLE AND PURPOSE: This Chapter shall be known
and cited as the Eagle Solid Fuel Heating Appliance Ordinance.
The purpose of this Chapter is to protect air quality resources
vital to public health and safety and the economic future of Eagle
by controlling emissions from the burning of solid fuel.
7-1E-2: DEFINITIONS: For the purposes of this Chapter, the
following terms, phrases, words and derivations shall have the
meanings given herein. The word "shall" is always mandatory and
not merely directory.
BUILDING
PERSON
Any structure, dwelling, office,
industrial plant, garage, or barn,
whether publicly or privately owned,
or any other structure as defined by
the Uniform Building Code as adopted
by Chapter 1, Title 7, Eagle City
Code.
Any individual, firm, partnership,
association, corporation, company,
organization, or governmental
entity.
SOLID FUEL Any form of untreated wood or coal.
SOLID FUEL HEATING APPLIANCE A device designed for solid fuel
combustion so that usable heat is
derived for the interior of a
building, including, but not limited
to, solid fuel fired cooking stoves,
pot-bellied stoves, franklin stoves,
air tight stoves, fireplace inserts,
or combination fuel furnaces or
boilers which burn solid fuel.
Fireplaces with air to fuel ratios
that exceed thirty (30) to one (1)
are exempt.

7-1E-3: SOLID FUEL HEATING APPLIANCE PERMITS:
A. It shall be unlawful for an owner of any new or existing
building in the incorporated area of Eagle to install or
allow to be installed a solid fuel heating appliance in his
or her new or existing building without first obtaining from
the City Clerk a solid fuel heating appliance permit.
B. It shall be unlawful on or after July 1, 1987, for any person
in the incorporated area of Eagle to: advertise for sale,
offer to sell, sell, for installation in any new or existing
building, or install in any new or existing building, a solid
fuel heating appliance which has not been certified as clean
burning by the Oregon Department of Environmental Quality.
7-1E-4: ISSUANCE OF SOLID FUEL HEATING APPLIANCE PERMITS:
A. No solid fuel heating appliance permit shall be issued by the
City Clerk for the installation of a solid fuel heating
appliance which has not been certified as clean burning by
the Oregon Department of Environmental Quality.
B. The City Clerk shall maintain a list of appliances certified
to be clean burning by the Oregon Department of Environmental
Quality.
7-1E-5: PENALTY: A violation of any of the provisions of this
Chapter, or the failure or omission to perform any duty imposed by
the provisions of this Chapter is hereby declared unlawful and
punishable as a misdemeanor.
Section 2: This ordinance shall take effect and be in
force from and after its passage, approval, and publication.

A summary of the principal provisions of
Ordinance No. 119 of the City of Eagle, Idaho,
adopted on August 11, 1987, is as follows:
Section 7-1E-1: Establishes the short title and
purpose of the Ordinance.
Section 7-1E-2: Defines the terms and phrases
used in the Ordinance.
Section 7 -IE -3: Requires permits for the in-
stallation of solid fuel heating appliances and
prohibits the installation of solid fuel heating
appliances which are not certified as clean
burning.
Section 7-1E-4: Provides for the issuance by the
City Clerk of solid fuel heating appliance permits
and mandates that the Clerk shall maintain a list
of certified appliances.
Section 7-1E-5: Declares that a violation of any
of the provisions of the Chapter is unlawful and
punishable as a misdemeanor. The full text of
Ordinance No. 119 is available at City Hall and
will be provided to any citizen upon personal
request during normal operating hours.
