AN ORDINANCE AMENDING SECTION 1-7-4, EAGLE CITY CODE, TO PROVIDE
FOR INCREASES IN ANNEXATION, REZONING, AND FLOOD PLAIN APPLICATION
FEES; ESTABLISHING FEES FOR CERTAIN LAND USE PLANNING
APPLICATIONS; PROVIDING FOR WAIVER OF FEES IN HARDSHIP SITUATIONS;
AND PROVIDING EFFECTIVE DATE
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE,
IDAHO, as follows:
Section 1: That Section 1-7-4, Eagle City Code, be, and the
same is hereby, amended to read as follows:
A. Fee Schedule Established: The City Clerk, at the time
of the filing of the application, shall collect the following fees
for land use planning actions requested of the City of Eagle
within the City limits together with any direct costs incurred by
the City in obtaining a review of the application, by architects,
engineers or other professionals,.necessary to enable the City to
approve or disapprove the application in an informed manner:
Annexation. Rezoning. Flood Plain

B. Area of Impact Referrals: The City Clerk, upon receipt
of each referral to the City pursuant to Orckirranee Ne --62 Title 8.
Chapter 8. Eagle City Code. and Revel tti-err-4Fer.--6-88- e --o4
1-mpaet-Agreement}r the Area of Impact Agreement between the City
and Ada County, shall collect from the applicant a fee of twenty-
five dollars ($25.00) .together with any direct costs incurred by
the City in obtaining a review of the referral by architects,
engineers or other professionals necessary to enable the City to
approve or disapprove the application in an informed manner.
C. Payment of Fees Prior to Action by the City: Until all
fees charged and expenses established by this Section have been
paid in full, no action shall be taken by the City on any applica-
tion or referral to which this Section applies.
D. Refunds: Fees charged pursuant to this Section shall
not be refundable.
E. Waivers: The City Council shall have the authority, in
its sole discretion, to waive, in whole or in part. the foregoing
fees. for good cause shown. in cases of financial hardship.
