ORDINANCE NO. 126
AN ORDINANCE AMENDING SECTION 1-10-1, EAGLE CITY CODE, AND
ORDINANCES NOS. 1, 6, 8, 11, 30, 34, 44, 45, 46, 49, 63, 64, 65,
66, 67, 71, 105, 107, 108, 110, 114, AND 118 OF THE CITY OF EAGLE
TO CORRECT THE LEGAL DESCRIPTIONS OF REAL PROPERTY ANNEXED TO THE
CITY OF EAGLE BY SAID ORDINANCES, AND PROVIDING EFFECTIVE DATE
WHEREAS, the City of Eagle, Idaho (the "City"), is a
municipal corporation duly organized and operating under the laws
of the State of Idaho and is authorized to annex to and
incorporate within the boundaries of the city contiguous real
property; and
WHEREAS, the City has at various times duly adopted
ordinances, more particularly specified hereinafter, establishing
the boundaries of the City and annexing certain contiguous real
properties to the City in accordance with the procedures required
by law; and
WHEREAS, the City has undertaken a complete review of all
legal descriptions of its boundaries and of properties annexed to
the City since its original incorporation and has determined that
the legal descriptions of property contained in Ordinances Nos. 1,
6, 8, 11, 30, 34, 44, 45, 46, 49, 63, 64, 65, 66, 67, 71, 105,
107, 108, 110, 114, and 118 should be corrected in certain
respects; and
WHEREAS, said corrections are of a technical rather than of a
substantive nature, and no consents, notices, hearings, or other
procedural steps are required as conditions precedent to the
correction of such legal descriptions as set forth hereinafter.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE CITY OF EAGLE, IDAHO, as follows:
Section 1: That the legal description of the original
boundaries of the City of Eagle contained in Section 1-10-1, Eagle
City Code, as established by Ordinance No. 1 and amended by
Ordinance No. 6, is hereby amended to read as set forth in Exhibit
"A" which is annexed hereto and by reference incorporated in this
Ordinance as if fully set forth herein.
Section 2: That the legal description of the real property
described in Section 1 of Ordinance No. 8, adopted by the Eagle
City Council on January 25, 1972, be, and the same is hereby,
amended to read as set forth in Exhibit "B" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 3: That the legal description of the real property
described in Section 1 of Ordinance No. 11, adopted by the Eagle
City Council on May 8, 1972, be, and the same is hereby, amended
to read as set forth in Exhibit "C" which is annexed hereto and by

reference incorporated in this Ordinance as though fully set forth
herein.
Section 4: That the legal descriptions of the real property
described in Ordinance No. 30, adopted by the Eagle City Council
on December 23, 1976, as amended by Ordinance No. 33 and
Resolution No. 1977-1, be, and the same are hereby, amended to
read as set forth in Exhibit "D" which is annexed hereto and by
reference incorporated in this Ordinance as though fully set forth
herein.
Section 5: That the legal description of the real property
described in Ordinance No. 34, adopted by the Eagle City Council
on May 10, 1977, be, and the same is hereby, amended to read as
set forth in Exhibit "E" which is annexed hereto and by reference
incorporated in this Ordinance as though fully set forth herein.
Section 6: That the legal description of the real property
described in Section 1 of Ordinance No. 44, adopted by the Eagle
City Council on November 25, 1979, be, and the same is hereby,
amended to read as set forth in Exhibit "F" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 7: That the legal description of the real property
described in Section 1 of Ordinance No. 45, adopted by the Eagle
City Council on November 25, 1979, be, and the same is hereby,
amended to read as set forth in Exhibit "G" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 8: That the legal description of the real property
described in Section 1 of Ordinance No. 46, adopted by the Eagle
City Council on November 12, 1980, be, and the same is hereby,
amended to read as set forth in Exhibit "H" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 9: That the legal description of the real property
described in Section 1 of Ordinance No. 49, adopted by the Eagle
City Council on November 12, 1980, be, and the same is hereby,
amended to read as set forth in Exhibit "I" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 10: That the legal description of the real property
described in Section 1 of Ordinance No. 63, adopted by the Eagle
City Council on November 12, 1980, be, and the same is hereby,
amended to read as set forth in Exhibit "J" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 11: That the legal description of the real property
described in Section 1 of Ordinance No. 64, adopted by the Eagle

City Council on November 12, 1980, be, and the same is hereby,
amended to read as set forth in Exhibit "K" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 12: That the legal description of the real property
described in Section 1 of Ordinance No. 65, adopted by the Eagle
City Council on November 12, 1980, be, and the same is hereby,
amended to read as set forth in Exhibit "L" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 13: That the legal description of the real property
described in Section 1 of Ordinance No. 66, adopted by the Eagle
City Council on November 12, 1980, be, and the same is hereby,
amended to read as set forth in Exhibit "M" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 14: That the legal description of the real property
described in Section 1 of Ordinance No. 67, adopted by the Eagle
City Council on November 12, 1980, be, and the same is hereby,
amended to read as set forth in Exhibit "N" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 15: That the legal description of the real property
described in Section 1 of Ordinance No. 71, adopted by the Eagle
City Council on June 9, 1981, be, and the same is hereby, amended
to read as set forth in Exhibit "0" which is annexed hereto and by
reference incorporated in this Ordinance as though fully set forth
herein.
Section 16: That the legal description of the real property
described in Section 1 of Ordinance No. 105, adopted by the Eagle
City Council on July 8, 1986, be, and the same is hereby, amended
to read as set forth in Exhibit "P" which is annexed hereto and by
reference incorporated in this Ordinance as though fully set forth
herein.
Section 17: That the legal description of the real property
described in Section 1 of Ordinance No. 107, adopted by the Eagle
City Council on July 8, 1986, be, and the same is hereby, amended
to read as set forth in Exhibit "Q" which is annexed hereto and by
reference incorporated in this Ordinance as though fully set forth
herein.
Section 18: That the legal description of the real property
described In Section 1 of Ordinance No. 108, adopted by the Eagle
City Council on July 8, 1986, be, and the same is hereby, amended
to read as set forth in Exhibit "R" which is annexed hereto and by
reference incorporated in this Ordinance as though fully set forth
herein.

City Council on September 9, 1986, be, and the same is hereby,
amended to read as set forth in Exhibit "S" which is annexed

Section 20: That the legal description of the real property
described in Section 1 of Ordinance No. 114, adopted by the Eagle
City Council on October 14, 1986, be, and the same is hereby,
amended to read as set forth in Exhibit "T" which is annexed
hereto and by reference incorporated in this Ordinance as though
fully set forth herein.
Section 21: That the legal description of the real property
described in Section 1 of Ordinance No. 118, adopted by the Eagle
City Council on June 9, 1987, be, and the same is hereby, amended
to read as set forth in Exhibit "U" which is annexed hereto and by
reference incorporated in this Ordinance as though fully set forth
herein.
Section 22: It is the intent of the City Council that the
amended description of each property set forth in Sections 2
through 21 hereinabove be deemed to speak from the date of the
ordinance annexing each such property, and that each parcel as
described hereinabove be deemed to have been annexed to the City
from the date of each annexing ordinance.
Section 23: If any word, phrase, or section of this
Ordinance shall for any reason be declared by a court of competent
jurisdiction to be invalid, then such word, phrase, or section
shall be deemed to be severable from and shall not affect the
validity of the remainder of this Ordinance.
Section 24: This Ordinance shall take effect and be in force
from and after its passage, approval, and publication. In lieu of
publication of the entire Ordinance, a summary of this Ordinance
in compliance with Section 50-901A may be published.

AFFIDAVIT AUTHORIZING PROP ERTY DESCRIPTION CORRECTIONS
CITY OF EAGLE, IDAHO - ANNEXATION ORDINANCE NO. 126
Dated December 8, 1987 - Published December 10, 1987
I, Carlyle W. Briggs, P.E./L.S., a Professional Engineer and Land Surveyor,
licensed by the State of Idaho, and presently serving as the City of Eagle, Idaho
Engineer, do hereby certify that I prepared necessary corrections to the legal
land descriptions for all City of Eagle annexation descriptions to date, as
shown in Ordinance No. 126, in an effort to eliminate gaps and overlaps, and to
adjust all descriptions to conform to the State Plane Coordinate System official
coordinates established for listed survey points surveyed by and for and adopted
by Ada County.
Further information has been received since the passage of Ordinance No. 126. and
this affidavit is for the purpose of correcting description errors discovered since
the date of filing, and requesting the Eagle City Clerk and others to file and
reference the attached corrected descriptions and map to said Ordinance No. 126.
Copies of this affidavit are being furnished to all those who were furnished
ordinance and map copies.
The necessary corrections in Ordinance No. 126 descriptions of land annexed are
as follows:
1. Section 4: Corrects the legal description of the real property
described in Ordinance No. 30, adopted on December 23, 1976, as amended by Ordinance
No. 33 and Resolution No. 1977-1.
Attached hereto is a corrected description entitled "Eagle East Annexation"
dated 12-30-87, Exhibit D, which deletes the Eagle Hills Golf Course area, which
were inadvertently included in the Ordinance No. 126 description.
The attached corrected description also deletes the Don Wilder property
in accordance with Court Order Case No. 68792, as recorded under Instrument No.
8006899, on Feb. 5, 1980, in the office of the Ada County Recorder, which super-
sedes and voids the Ordinance No. 126 descriptions with the same title.
Also attached hereto is corrected description entitled "Eagle West Annexation"
dated 12-30-87, Exhibit D, which deletes a portion of the Matlock property, which
was inadvertently included in the description, and which supersedes and voids the
Ordinance No. 126 descriptions with the same title.
2. Section 7: Corrects the legal description of the real property
described in Section 1 of Ordinance No. 45, adopted on November 25, 1979, Exhibit
G. Attached hereto is the corrected description entitled "Eagle Annexation
Ordinance No. 45 Corrected Description" dated 12-30-87, which supersedes and voids
the Ordinance No. 45 description with the same title, and deletes a small land
area between South Channel Road and the Section Line, which was erroneously
included in the Ordinance No. 126 description.
3. Section 15: Corrects the legal description of the real property
described in Section 1 of Ordinance No. 71, adopted on June 9, 1981. Attached
hereto is the corrected description entitled "Eagle Annexation Ordinance No. 71
Corrected Description" Exhibit 0, dated December 30, 1987, which supersedes and
voids the Ordinance No. 126 description with the same title, and adds a bearing
callout to the next to last line on Page 1.

THIS CAUSE came on for hearing on October 11, 1979, and the
Court, having heard and considered the evidence, and considered
the stipulations of the parties, hereby finds the facts and
states the conclusions of law as follows:
FINDINGS OF FACT
1. The Petitioners, Donald E. Wilder and Audrey L. Wilder,
husband and wife, are residents of the City of Eagle, County of
Ada, State of Idaho.
FINDINGS OF FACT, CONCLUSIONS
OF LAW AND JUDGMENT -1-
2. The Respondent, City of Eagle, is a municipal corpora-
tion incorporated under the laws of the State of Idaho and
located in Ada County, Idaho.
3. Petitioners are owners of the following described real
property located within the corporate limits of the City of
Eagle, Ada County, State of Idaho:
A parcel of land lying in a portion of the E
1/2 of the SE 1/4 of the SE 1/4 (South of the
drain ditch) of Section 9, T. 4N., R. 1E.,
B.M., Ada County, Idaho, and more particularly
described as follows:
Beginning at a brass cap marking the South-
east corner of the said SE 1/4 of Section 9,
also said point being the REAL POINT OF
BEGINNING;
thence North 0°14'12" West 432.96 feet along
the Easterly boundary of the said SE 1/4 of
V which is also the centerline of Edgewood Road,
to a point on the centerline of a certain
drainage ditch;
thence North 88°44'10" West 24.22 feet along

iron pin marking the Southwest corner of the

along the Southerly boundary of the SE 1/4 of
Section 9 to the point of beginning, compris-
ing 10.89 acres, more or less.
4. The property described in Finding of Fact No. 3 is a
single parcel of property consisting of more than five acres.
5. The property described in Finding of Fact No. 3 is
currently and has consistently in the past been used by
Petitioners as pasture land for Petitioners' cattle, and has been
used at all times by Petitioners exclusively for agricultural
purposes.
6. The real property described in Finding of Fact No. 3
does not receive any special benefits from the City of Eagle,
resulting from the property being within the.corporate limits of
the City.
7. The parcel of property described in Finding of Fact No.
3 is located in the Southeastern corner of the City, and its
detachment from the corporate limits of the City would not give
the City an unusual shape, would not create a hole in the City's
boundaries, and would not leave any small narrow necks of
property existing. within the corporate limits of the City.
8. The parcel of property described in Finding of Fact No.
3, being located on the edge of the City, is not surrounded with

land within the City limits being used in a variety of ways, with
the uses being related to the existence of the community. On the
contrary, the parcel of property is surrounded only by agri-
cultural land, and the supervision of the City of Eagle over
lands adjacent to or in close proximity with the business and
homes located within the corporate limits of the City will not be
denied or adversely affected if the Petitioners' property is
detached and disannexed.
9. There is no indication from the evidence that the parcel
of property described in Finding of Fact No. 3 is being developed
for uses incompatible with uses for which adjacent or affected
lands within the corporate limits of the City are being employed.
10. The exterior of the physical symmetry of the, outside
boundaries of the City of Eagle will be no less uniform after
detachment of Petitioners' property than it is now, there being
many irregularities presently in the symmetry of the City's
boundaries. When the Petitioners' property was annexed into the
City, the City limits of Eagle were considerably extended.
Therefore, the detachment of the Petitioners' property from the
corporate limits of the City will not, with respect to the
geometric shape of the City, adversely effect the due proportion
of the parts of a body, conformance and consistency, and
correspondence or similarity of form on opposite sides of an axis
or center. In short, detachment of Petitioners' property, as
described in Finding of Fact No. 3, will not materially mar the
symmetry of the City of Eagle.
11. None of Petitioners' statements supporting any
annexation of the City of Eagle had any effect on the City's
decision to annex Petitioners' property, nor did the City place
any reliance thereon.
FINDINGS OF FACT, CONCLUSIONS
OF LAW AND JUDGMENT -4-
12. The City of Eagle did not rely upon any representation
by Petitioners regarding the City's proposed annexation to the
City's detriment or prejudice.
CONCLUSIONS OF LAW
1. Petitioners' property (as described in Finding of Fact
No. 3) is a single parcel of property, located within the
corporate limits of the City of Eagle, consisting of over five
acres, and is used exclusively for agricultural purposes within
the meaning of Idaho Code §50-226 et s�ce .
2. Petitioners' property does not receive sufficient
special benefits to justify the retention of said property within
the corporate limits of such City.
3. Detachment of Petitioners' parcel of property will not
materially mar the symmetry of the City within the meaning of
Idaho Code §50-230.
4. The doctrine of equitable estoppel based on a property
owner's initial acquiescence to annexation of property is
inapplicable to subsequent proceedings to disannex that property
instituted pursuant to Idaho Code §50-226 et seq.
5. The City of Eagle did not rely to its prejudice or
detriment on any representation made by Petitioners, or either of
them, relating to the initial annexation of Petitioners' property
into the City of Eagle.
6. Petitioners have established as a matter of law all of
the elements prescribed by I.C. S50-226 et Lta. necessary for
disannexation under said statutes. Therefore, Petitioners are
entitled to have their Petition granted, and have their property
detached and disannexed from the corporate limits of the City of
Eagle.
FINDINGS OF FACT, CONCLUSIONS
OF LAW AND JUDGMENT -5-
Based upon the foregoing Findings of Fact and Conclusions of
law, now, Therefore, IT IS. HEREBY ORDERED, ADJUDGED AND DECREED,
and this does so ORDER, ADJUDGE AND DECREE:
1. That Petitioners' Petition in the above -entitled action
is granted, and that the parcel of property described in Finding
of Fact No. 3 hereinabove, hereby is wholly detached and
disannexed from the corporate limits of the City of Eagle, and
that from this date forward the''Petitioners' property shall be
free and apart from the government of the municipal corporation,
the City of Eagle.
2. That within twenty days after the execution and filing
of these Findings of Fact, Conclusions of Law and Judgment,
Petitioners shall file or cause to be filed with the County
Recorder of Ada County and with the City Clerk of the City of.
Eagle, a certified copy of these Findings of Fact, Conclusions of
Law, and Judgment and Decree.
