AN ORDINANCE OF THE CITY OF EAGLE, OF ADA COUNTY, IDAHO, AMENDING
SECTION 4-2-5, EAGLE CITY CODE, TO REQUIRE A PERSON TO OBTAIN A
LICENSE BEFORE ENGAGING IN THE BUSINESS OF COLLECTING AND HAULING
GARBAGE AND TO ESTABLISH A LICENSE APPLICATION PROCEDURE AND
LICENSE FEE; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE,
IDAHO, as follows:
Section 1: That Section 4-2-5, Eagle City Code, be, and the
same hereby is, amended to read as follows:
4-2-5 COLLECTIONS REGULATED:
A. Exclusive Right of City to Collect: The City, its
duly authorized agents, contractors, servants,
employees or and licensees shall have the
exclusive right to gather and collect garbage and
rubbish within the City, and it shall be unlawful
for any person, except as otherwise provided in
this Chapter, to eekkeeb-or-gabber enaaae in the
business of collectins or aatherinq garbage or
rubbish within the City.

B. License to Collect: Persons engaged in the
business of collecting and hauling. convevina. or
transporting rubbish or garbage upon the streets or
alleys within the City of Eagle shall have a valid
license therefore issued by the City. Application
for such license shall be made in writing upon a
form to be provided by the Eagle City Clerk. The
application shall show the name. telephone number.
and street address of the applicant. number of
vehicles to be used in such business. and such
other pertinent information as the Eagle City
Council may reauire. Whenever a new or different
vehicle other than as shown in such application is
used in such business, the applicant shall furnish
immediately such information to the Clerk.
Upon inspection and certification by an individual
designated by the City Council of each vehicle used
in an aDDlicant's business to haul. convey, or
transport rubbish or aarbaae. the City Council
shall order the City Clerk to issue a license to
the applicant. which shall be issued for the
calendar year and shall exvire on the 31st day of
December of the year in which issued. No license
issued under the provisions hereof may be
transferred.
All persons licensed under the provisions of this
section shall pay a license fee of 512.50 per month

month or as otherwise provided.

Section 2: This Ordinance shall take effect and be in force
from and after its passage, approval, and publication.
