AN ORDINANCE ESTABLISHING THE ZONING CLASSIFICATION OF THE REAL
PROPERTY DESCRIBED HEREIN AS A OR AGRICULTURAL; AMENDING THE
ZONING MAP OF THE CITY OF EAGLE TO REFLECT SAID CHANGE; AND
PROVIDING EFFECTIVE DATE
WHEREAS, the real property particularly described in Section
2 of this ordinance was heretofore annexed to the City of Eagle;
and
WHEREAS, the Planning and Zoning Commission of the City of
Eagle has, on July 5, 1988, pursuant to public notice as required
by law, held and conducted a public hearing on the zoning
classification for said real property and has made findings,
conclusions, and a recommendation to the City Council on said
zoning classification; and
WHEREAS, the City Council of the City of Eagle has, on July
12, 1988, pursuant to public notice as required by law, held a
public hearing on the proposed zoning classification, has made
findings and conclusions as required by law, and has determined
that said real property should be included in the A or
Agricultural Zone as provided by the Zoning Ordinance of the City
of Eagle.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE CITY OF EAGLE, IDAHO, as follows:
Section 1: The City Council of the City of Eagle hereby
finds and determines that it is in the best interests of the real
property described in Section 2 below and of the public health,
safety, and welfare of the City of Eagle, that said real property
be included in the A or Agricultural Zone as provided by the
Zoning Ordinance of the City of Eagle. The City Council further
finds and determines that said zoning classification is in
conformance with the Comprehensive Plan of the City of Eagle.
Section 2: The real property, all situate in the City of
Eagle, Ada County, Idaho, and more particularly described in
Exhibit A which is annexed hereto and by reference made a part of
this ordinance as though fully set forth herein, is hereby
included in the A or Agricultural Zone of the City of Eagle, all
pursuant to the Zoning Ordinance of the City of Eagle.
Section 3: The official Zoning Map of the City of Eagle,
Idaho, is hereby amended to reflect the foregoing zoning
classification.

Section 4: This ordinance shall take effect and be in force
from and after its passage, approval, and one (1) publication
thereof, or of a summary thereof in conformance with Section 5D -
901A, Idaho Code, in the off 'al newspaper of the City.

A summary of Ordinance No. 139, adopted by the Eagle City
Council on July 26, 1988, is as follows:
Section 1: Makes findings and declaration that certain real
property be included in the A or Agricultural Zone.
Section 2: Provides that the real property, all situate in
the City of Eagle, Ada County, Idaho, particularly described in
Exhibit "A," be included in the A or Agricultural Zone. Said
property is situate West of Eagle Road and North and South of
Channel Road.
Section 3: Amends the Zoning Map to reflect said zoning
classification.
Section 4: Provides that the ordinance will take effect upon
its passage, approval, and publication.
