Ordinance - 1990 - 160 - Changing Zoning Classification - 03/16/1990ORDINANCE NO. 160 AN ORDINANCE CHANGING THE ZONING CLASSIFICATION OF THE REAL PROPERTY DESCRIBED HEREIN FROM THE R-5 RESIDENTIAL CLASSIFICATION TO R-12 RESIDENTIAL CLASSIFICATION; AMENDING THE ZONING MAP OF THE CITY OF EAGLE TO REFLECT SAID CHANGE; AND PROVIDING EFFECTIVE DATE WHEREAS, the real property particularly described in Section 2 hereinafter is presently included in the R-5 Residential zone classification under the zoning ordinance of the City of Eagle, and the owner thereof has requested a change of the zoning classification of said property to the R-12 Residential District; and WHEREAS, the Planning and Zoning Commission of the City has, on January 15, 1990, pursuant to public notice as required by law, held a public hearing on the requested zone change, made findings and conclusions, and has recommended to the City Council approval of the requested change in zoning classification; and WHEREAS, the City Council of the City of Eagle has, on February 13, 1990, pursuant to public notice as required by law, held a public hearing on the requested zone change, made findings and conclusions as required by law, and has determined that the requested zone change should be granted. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO, AS FOLLOWS: Section 1: The City Council hereby finds and determines that it is in the best interests of the public health, safety, and welfare of the City of Eagle and the residents and property therein that the real property particularly described in Section 2 below be removed from the R-5 Residential classification and included in the R-12 Residential District, all pursuant to the Zoning Ordinance of the City of Eagle. The City Council further finds and determines that said zone change is in conformance with the Comprehensive Plan of the City of Eagle. Section 2: The following described real property, all situated in the City of Eagle, Ada County, Idaho, is hereby removed from the R-5 Residential Zone and included in the R-12 Residential Zone: A TRACT OF LAND IN THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 9, TOWNSHIP 4 NORTH, RANGE 1 EAST, BOISE - MERIDIAN, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF LOT 1 BLOCK 6 AIKENS ADDITION TO EAGLE, IDAHO, ACCORDING TO THE OFFICIAL PLAT THEREOF, RECORDED IN BOOK 3 OF PLATS AT PAGE 145, RECORDS OF ADA COUNTY, IDAHO; THENCE EAST 250 FEET ALONG THE SOUTH LINE OF SAID BLOCK AND THE EXTENSION THEREOF, MORE OR LESS, TO THE WEST LINE OF THE TRACT CONVEYED TO IDAHO POWER COMPANY, RECORDED IN BOOK 355 OF DEEDS AT PAGE 84, RECORDS OF ADA COUNTY, IDAHO; THENCE SOUTH 295 FEET, MORE OR LESS TO THE CENTER LINE OF THE DRAIN DITCH; THENCE 250 FEET, MORE OR LESS SOUTH 86°30' WEST ALONG THE CENTER LINE OF SAID DRAIN DITCH TO A POINT 295 FEET SOUTH OF THE SOUTHWEST CORNER OF LOT 1, BLOCK 6 OF AIKENS ADDITION TO EAGLE, IDAHO; THENCE 295 FEET NORTH TO THE PLACE OF BEGINNING. EXCLUDING THEREFROM, THE FOLLOWING DESCRIBED TRACT OF LAND: A TRACT OF LAND IN THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 9, TOWNSHIP 4 NORTH, RANGE 1 EAST, BOISE - MERIDIAN, ADA COUNTY, IDAHO, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF SAID LOT 4, BLOCK 6 OF AIKENS ADDITION TO THE TOWNSITE OF EAGLE, ACCORDING TO THE OFFICIAL PLAT THEREOF RECORDED IN BOOK 3 OF PLATS AT PAGE 145, RECORDS OF ADA COUNTY, IDAHO; RUNNING THENCE EAST, ON AN EXTENSION OF THE SOUTH LINE OF SAID LOT 50 FEET, MORE OR LESS TO THE WEST LINE OF THE TRACT CONVEYED TO THE IDAHO POWER COMPANY, RECORDED IN BOOK 355 OF DEEDS AT PAGE 84, RECORDS OF ADA COUNTY, IDAHO; THENCE SOUTH 133 FEET TO A POINT; THENCE WEST 250 FEET, MORE OR LESS, ON A LINE PARALLEL TO THE SOUTH BOUNDARY LINE OF BLOCK 6 OF AIKENS ADDITION TO THE TOWNSITE OF EAGLE, TO A POINT ON THE EAST LINE OF SECOND STREET EXTENDED; THENCE NORTH 133 FEET, MORE OR LESS, TO THE SOUTH LINE OF LOT 1, BLOCK 6 OF AIKENS ADDITION TO THE TOWNSITE OF EAGLE; THENCE EAST 200 FEET ALONG THE SOUTH LINE OF SAID BLOCK 6 TO THE POINT OF BEGINNING. Section 3: The official Zoning Map of the City of Eagle, Idaho, is hereby amended to reflect the foregoing change in zoning classification. Section 4: This ordinance shall take effect and be in force from and after its passage, approval, and one (1) publication of the ordinance, or a summary thereof in conformance with Section 50- 901A, Idaho code, in the official newspaper of the City. Section 2: Changes the zoning classification from R-5 to R-12 in the SW 1/4 of the SW 1/4 of Sec. 9, T.4N, R.1E, B.M. Eagle, Idaho. Section 3: Amends the official Zoning Map of the City. Section 4: Provides for effective date.
