MINUTES
The Design Review Board met in regular session on February 8, 2024. Lindgren presiding.
1. CALL TO ORDER: Chairman Lindgren calls the meeting to order at 6:00 p.m.
2. ROLL CALL: Present: SAYER, DUPERAULT, LINDGREN, GREER. Absent:
GRUBB, MERRILL, MIHAN.
3. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED
ACTION ITEMS. Consent Agenda items are considered to be routine and are acted on with
one motion. There will be no separate discussion on these items unless a Design Review
Board member or City Staff requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order. Any item on the Consent Agenda that
contains written recommendations from the City of Eagle shall be adopted as part of the
Design Review's Consent Agenda approval motion unless specifically stated otherwise.

B. Findings of Fact and Conclusions of Law for the Approval of DR-43-21 MOD3 -
Modification to the Common Area Landscaping, Amenities, and Pool House
within Arvory Crest Subdivision - Lennar Homes of Idaho: Lennar Homes of
Idaho, represented by Makayla Murphy with EV Studios, is requesting design review
approval to modify the common area landscaping, amenities, and pool house within
Arvory Crest Subdivision. The 80.2-acre site is located on the southeast corner of West
Floating Feather Road and State Highway 16 at 1252 North Highway 16. (ERF)
C. Findings of Fact and Conclusions of Law for the Approval of DR-38-23 -
Common Area Landscaping and Building Architecture within Dovetail Condos -
Eagle Tail Development: Eagle Tail Development, represented by Chad Palmer, is
requesting design review approval of the common area landscaping and building
architecture (4-two-family dwellings) within Dovetail Condos. The 1.58-acre site,
consisting of two lots (Lots 6 & 7, Block 2, Randall Acres Subdivision No. 15), is
located on the north side of East Dunyon Street approximately 300-feet east of the
intersection of East Dunyon Street and South Conover Street at 2056 and 2078 East
Dunyon Street. (BAW)
D. Findings of Fact and Conclusions of Law for the Approval of DR-61-23 -
Common Area Landscaping within Shetland Point Subdivision - A Team Land
Consultants: Steve Arnold with A Team Land Consultants is requesting design
review approval for the common area landscaping within Shetland Point Subdivision.
The 5.10-acre site is located on the west side of North Park Lane approximately 400-
feet south of the intersection of West Floating Feather Road and North Park Lane at
1025 North Park Lane. (ERF)
Sayer moves to approve the consent agenda. Seconded by Duperault.

4. UNFINISHED BUSINESS: None.
5. NEW BUSINESS:
A. ACTION ITEM.. DR-03-03 MOD2 - Change of Use, including Modification to The
Home Depot Site Located within Eagle Promenade Shopping Center - The Home
Depot: The Home Depot, represented by Cassandra Permenter with Scott A. Mommer
Consulting, is requesting design review approval to change the use of the site to
include "equipment rental and sales yard" to accommodate the rental of moving trucks,
including a modification to the parking area to designate areas for product storage,
outdoor sales, and equipment rentals. The 12.5-acre site is located on the northeast
corner of State Highway 55 and State Highway 44 at 2808 East State Street within the
Eagle Promenade Shopping Center. (ERF)

and responds to questions from the Board.
Planner, Emily Falco, provides an overview of the application and responds to
questions from the Board.
Lindgren moves to approve DR-03-03 MOD2 with the site specific conditions 1-5
as written with the following modifications.
Site specific condition # 6: For the applicant to provide a site plan showing and
clarifying the directional/re-directional arrow illustrating the actual location of
the existing compact power rental location to be more towards/tighter to the
building on the east versus where it is currently shown on site plan to be out
closer to the parking area and in addition to that within the specific condition
number six is for the up to clearly identify the six stalls to where the truck rental
parking will be located on the north side of the building.
Site specific condition #7: With respect to the sod shed that is currently located in
view from the highway along the west side of the parking lot to either provide
additional evergreen screening to provide screen from view the sod shed or to
relocate that sod shed to adjacent locate to location that we will describe your
further and I apologize staff with respect to this is kind of related to the shed
relocation, so OK let me back up specific number seven to move the side shed to
the side shed as it has his current location or to move the sod shed more internally
and again, to where it would be screened by existing tree lined area and again
moving it out of the view from the highway.
Site specific condition # 8: Provide a revised site plan to relocate the location of
the current shed, which is essentially located the mid part of the parking lot and
more and more of a linear fashion, more clustered and to be located farther to the
perimeter to the west as previously described under this discussion by staff.
Site specific conditions #7 and #8 to be reviewed by staff. These are all required
prior to the issuance of a building certificate.

History
On March 13. 2001. the Eagle City Council approved a preliminary plat application and conditional
use application for Eagle Towne and Country Centre (13P-13-00%Ct:i-13-00).
On April 24. 2001. the Eagle City C'otmcil approved a design review application for the common area
landscaping ttiitltui Eagle Towne and Country Centre including a building design for WinCo Foods
(DR-6-01).
Orn Febniary 12. 2002. the Eagle City Council approved a preliminary plat extension time application
for Eagle Towne and Country Centre (PP-18-00) for one year until March 13. 2003.
On February 26. 2002. the Eagle City Council approved a design review extension of time application
for Eagle Towne and Country Centre including the building design for WinCo Foods (DR-6-01) for
one year tuuil April 24. 2003.
On March 11. 2003. the Eagle City Council approved a design review application to constnrct a home
irnprovement store with a garden center (DR-03-03).
On September 9. 2003. the Eagle City Council approved a design review application for building wall
signs for The Home Depot (DR-30-031.
Oii March 9. 2017. the Design Review Board approved a design review application to modify site
specific condition of approval 43 established with the approval of DR-03-03 to permit product storage
and outdoor sales within the parking lot (DR-03-03 MOD).

pointing to the area adjacent to the building. Add a note to the site plan identifying the six parking spaces
located north of the building and east of the garden center staging area as truck rental parking. The revised site
plan shall be reviewed and approved by staff prior to the issuance of a zoning certificate authorizing the change
of use.

Site Specific Conditions of Approval
SITE SPECIFIC: CO\DITIONS OF APPROVAL:
1. Comply with all applicable conditions of CU-1 S-00 and DR-03-03.
2. Product storage. outdoor sale and displays. and equipment rentals shall be limited to the areas as
shown on the site plan. date stamped by the City on January 26. 2024.
3. Provide a landscape plan showing all existing landscaping on the site. The landscape plan shall be
reviewed and approved by staff prior to issuance of a zoning certificate.
4. The use of the property as "Equipment rental and sales yard" shall be limited to the rental of moving
trucks. The moving trucks shall be placed/stored/kept/displayed on the north side of the building only
within the designated six parking spaces. The rental trucks shall not be placecbkept/displayecVuor
dropped off on the south side of the building.
S. Maximum rental truck length shall be 26-feet.
