Ordinance - 1992 - 200 - Allow Commercial Motor Vehicles/Platted Subd - 03/24/1992fING611 ORDINANCE NO. 200 WAIL AN ORDINANCE AMENDING SECTION 5-5-1, EAGLE CITY CODE, TO ALLOW THE OPERATION OF COMMERCIAL MOTOR VEHICLES UPON ARTERIAL AND COLLECTOR STREETS WITHIN A PLATTED SUBDIVISION OF THE CITY OF EAGLE; AND TO PROVIDE AN EFFECTIVE DATE WHEREAS, the Mayor and Council of the City of Eagle find that the use of roadways within platted subdivisions by operators of commercial motor vehicles creates a safety hazard to the residents of such subdivisions; and WHEREAS, the Mayor and Council deem it necessary to restrict such use to ensure the health and safety of the City's residents; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO, as follows: Section 1: That Section 5-5-1, Eagle City Code, be, and the same hereby is, amended to read as follows: 5-5-1: SUBDIVISION ROADWAYS, USE OF: It shall be unlawful for any person to operate a commercial motor vehicle, as defined by Section 49-123 of the Idaho Code as it now exists, upon any readway minor street within a platted subdivision of the City of Eagle; provided, this Section shall not be construed to prohibit any person operating a commercial motor vehicle from using ouch r✓cAway an arterial or collector street within the subdivision for anv purpose or a minor street to provide goods or services to a property owner or lessee of property within the subdivision. Section 2: That this Ordinance shall take effect and be in force from and after its passage, approval, and one (1) publication of this Ordinance. DATED this day of March, 1992.
