Ordinance - 1994 - 239 - Manufactured Home - 02/22/1994ORIGINAL ORDINANCE NO. 239 AN ORDINANCE REPEALING THE DEFINITION OF MANUFACTURED HOME, SECTION 10-1-5, RULES AND DEFINITIONS, EAGLE CITY CODE; AND ENACTING A NEW SECTION 7-5.-1, EAGLE CITY CODE, TO ESTABLISH GUIDELINES FOR MANUFACTURED HOMES IN THE CITY OF EAGLE, TITLE 7 BUILDING REGULATIONS; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY IDAHO, as follows: SECTION 1: SECTION 2: 74-1: 7-5-2: 7-5-3: 7-5-4: 7-5-5: 7-5-6: 7-f-1: for the THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, That the definition of "Manufactured Home" in Section 10-1-5, Rules and Definitions of the Flood Control Code, be repealed. That new Sections 7-4-1 through 7-4-6 of the Eagle City Code, be, and the same hereby is enacted to read as follows: Purpose Definitions Development Standards Accessory Structures Administration and Enforcement Nonconforming Manufactured Homes PURPOSE: This Chapter establishes the minimum standards location and approval of manufactured housing. 7-4-2: DEFINITIONS Accessory Structure: A structure attached to or located adjacent to a manufactured home such as awnings, carports, garages, porches or steps. Manufactured Home: A structure built since June 1, 1976, that bears the Department of Housing and Urban Development certification that it has been constructed in conformance with the Mobile Home Construction and Safety Standards in effect at the time of its construction, and is to be used as a permanent residential dwelling. Licensing regulations by the State of Idaho, pursuant to Section 44-2101 of the Idaho State Code shall be observed. Permanently Affixed: A manufactured home which has the running gear and towing hitch, or similar devices, removed and is set up per manufacturer's instructions on permanent footings, with supports having an anchoring system that is totally concealed under the structure and complies with Department of Housing and Urban Development standards. Page 1 1 7-N-3: DEVELOPMENT STANDARDS: The use of a manufactured home as a permanent residential dwelling on an individual lot shall be permitted in any zoning district of the chapter which permits installation of a single family site -built dwelling provided the following standards are met: (A) Is multi -section and at least 20 feet wide; (B) Has a minimum floor area of 1,000 square feet; (C) Has roofing materials which are generally acceptable for site - built housing. Any roofing materials may be used provided it has the appearance of a nonmetallic shingle, shake or tile roof. Roofs shall also have a minimum slope of 25 percent (3:12) and overhanging eaves; (D) Has siding materials which are generally acceptable for site - built housing. Any siding materials may be used provided it has the appearance of wood, masonry or horizontal metal siding. Reflection from horizontal metal siding shall be no greater than that from siding coated with white, gloss enamel; (E) Has a foundation of concrete or other material allowed by the Uniform Building Code for site -built homes which is aesthetically compatible with the manufactured home having the appearance of site -built construction. This means the facia shall be an extension of the siding or be of materials having the appearance of site -built foundations such as brick, concrete or concrete block; (F) Is permanently affixed per manufacturer's instructions. Footings shall be of poured masonry extending 24 inches below grade; (G) Has a crawl space with the following minimum measurements: (a) 18 inches of clearance; (b) 12 inches of clearance under beams; and (c) an 18 -inch by 24 -inch door; (H) Complies with all applicable lot size, setback, and other requirements of the zoning district in which it is to be located; (I) Provides two off-street parking spaces and shall be improved with such material to provide a durable and dust -free surface (ECC 8-4-3.A and ECC 8-4-5); (J) Has a single car garage, or a carport with an attached enclosed storage room; Page 2 2 (K) Provides right-of-way improvements in the same manner as site - built construction, in accordance with City policy; (L) Manufactured homes shall not be allowed in subdivisions where they are prohibited by restrictive covenants; (M) Manufactured home owners or purchasers shall own or be purchasing the land upon which their home is to be placed. The owner or purchaser shall record with the County Recorder a nonrevocable option declaring the manufactured home as real property. These requirements shall not apply within any duly approved mobile home park. Exceptions may also be granted as a part of a planned unit development approval; (N) Manufactured homes shall meet the requirements of the Idaho Residential Energy Standards as adopted and amended in Title 7, Chapter 4, of Eagle City Code, or other equivalent standard approved by the City; (0) Manufactured homes shall be provided with smoke detectors as required in the Uniform Building Code, Section 1210, "Smoke Detectors and Sprinkler Systems" before final inspection and occupancy. Smoke detectors required in addition to those provided for in the Department of Housing and Urban Developments, Part 3280 of 24 C.F.R., "Manufactured Home Construction and Safety Standards," may be of the battery operated type (P) Manufactured homes not meeting standards B, E, J, N or 0 shall only be allowed in mobile home parks, as permitted pursuant to Title 8. Placement of manufactured homes not meeting standards B, E, J, N or 0 may be considered by the Planning Commission on a case-by-case basis in all other residential use districts in accordance with the conditional use permit provisions of Title 8, Chapter 7, Section 3. 7-%-4: ACCESSORY STRUCTURES: Accessory structures to manufactured housing shall be constructed in compliance with the standards specified by the Eagle Comprehensive Zoning Ordinance, Uniform Building Code, and the Department of Housing and Urban Development Standards. Structures shall be aesthetically compatible with the home to which they are associated. 7-4-5: ADMINISTRATION AND ENFORCEMENT: (A) Application: Application shall be made with the City of Eagle on a prescribed form. The completed application shall be filed with the City Clerk. The application shall include all information necessary to determine conformity with required development standards of this Chapter, including: exterior Page 3 3 dimensions, siding material, foundation facia material, roofing material, eaves overhang and any other applicable information. The applicant shall also attach to the application, (a) a copy of the manufacturer's instructions for installation of the home on permanent footings, and (b) a plot plan showing existing conditions and the proposed location of the home and other improvements at a scale of at least 1 inch 20 feet; (B) Certificates and Inspection: The applicant shall sign the completed application certifying the manufactured home meets the required development standards of this Chapter and that site development will be in accordance with said standards and the plot plan submitted stating that once the manufactured home is permanently affixed the applicant will comply with the requirement for the home to be declared as real property for taxation purposes. These certifications shall be made prior to the moving of the home to the building site; Following application and plot plan approval by the Eagle Building Official, the Official may issue a building permit for the footings and foundation. Upon satisfactory inspection of the footings and foundation for the attachment of the manufactured home, the Building Official shall verify, in writing, that all development standards have been met as certified by the applicant. The home may then be attached to the foundation in accordance with the manufacturer's instruction, City Codes for permanent utility connections, and other building requirements; Prior to occupancy a final inspection shall be made to assure proper attachment of the home to the foundation and placement of a proper foundation facia; . 7-$-6: NONCONFORMING MANUFACTURED HOMES: A manufactured home which has been placed and maintained upon an individual lot prior to February 22, 1994, shall be a legal nonconforming use. Such manufactured homes shall not be relocated within the City without conforming to all applicable provisions contained herein. A summary of the principal provision of Ordinance No. 239 of the City of Eagle, Idaho, adopted on February 22, 1994, consists of the following sections; SECTION 1: That the definition of "Manufactured Home" in Section 10-1-5, Rules and Definitions of the Flood Control Code, be repealed. SECTION 2: 7-(-1: Purpose SECTION 3: 7-4=2: Definitions SECTION 4: 7- 3: Development Standards SECTION 5: 7- 4: Accessory Structures SECTION 6: 7415: Administration and Enforcement SECTION 7: Nonconforming Manufactured Homes SECTION 8 : Provides for an effective date. These Sections set forth the minimum standards for the location and approval of manufactured housing. The principal provisions of the Ordinance include a defining Section, development standards for the design construction and placement of manufactures homes, requirements for accessory structures, provisions for applications to place manufactured homes and inspections; and grandfathering of non -conforming pre-existing manufactured homes. The effective date for this Ordinance shall be the date of this publication.
