ORDINANCE NO. 244
AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, AMENDING
TITLE 6 OF THE EAGLE CITY CODE TO ESTABLISH DESIGN CRITERIA FOR
BERMS AND FENCING ALONG ARTERIAL AND COLLECTOR STREETS.
13E IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, as follows:
Section 1: Section 6-7-4 of the Eagle City Code is hereby amended by adding a new
section F as follows:
F. Berms and fencing along arterial and collector streets:
The maximum height of berms in any subdivision shall not exceed eight (8')
feet measured vertically from the center line of the adjacent road. All fencing
separating subdivisions from arterial and collector roadways are to be
constructed of masonry or stone and not exceed six (6') feet, as measured
vertically from the center line of the adjacent road, nor be less than five (5')
feet in height. A person may apply to the Committee for a variance from
these requirements, which shall be granted upon a showing that a different
landscape design is more appropriate for the property.
Section 2: This ordinance shall take effect and be enforced after its passage,
approval, and publication as required by law. In lieu of publication, the entire ordinance and
summary thereof and compliance with Section 50-901A, Idaho Code, may be published.
